2929 An Act relative to promoting the betterment of resident health and safety in long term care
3030 facilities.
3131 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3232 of the same, as follows:
3333 1 Section 1. Chapter 111 of the Massachusetts General Laws is hereby amended by
3434 2inserting the following new sections after Section 72BB:-
3535 3 Section 72CC.The department, through its division of health care facility licensure and
3636 4certification, shall establish and implement a prescribed process and program for providing
3737 5training and education to providers licensed by the department. The department shall consult
3838 6with the industry trade associations, before requiring any new regulatory guidance, regulation,
3939 7interpretation, program letter or memorandum, or any other materials used in surveyor training to
4040 8survey licensed providers.
4141 9 The process, training, and education shall include, but not be limited to, the following: 2 of 2
4242 10 (1) annual training for long term care facilities on the licensure and certification process.
4343 11This training shall include, but not be limited to, the department’s interpretation of the general
4444 12laws, rules, regulations, procedures, and policies concerning the licensure and certification
4545 13process for such long-term care facilities;
4646 14 (2) biannual training of long-term care providers on the most frequently cited
4747 15deficiencies, identified deficiency trends, both state and federal, and best practices to ensure
4848 16resident quality of care; and
4949 17 (3) training of long-term care providers and the department survey inspectors jointly on
5050 18the department's new expectations; and
5151 19 Training shall be interactive, with the sharing of information and recommendations
5252 20between long term care facilities and the department on issues and topics.
