31 | 31 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
32 | 32 | | of the same, as follows: |
---|
33 | 33 | | 1 Section 1. Chapter 111 of the Massachusetts General Laws is hereby amended by |
---|
34 | 34 | | 2inserting the following new sections after Section 72BB:- |
---|
35 | 35 | | 3 Section 72CC.The department, through its division of health care facility licensure and |
---|
36 | 36 | | 4certification, shall establish and implement a prescribed process and program for providing |
---|
37 | 37 | | 5training and education to providers licensed by the department. The department shall consult |
---|
38 | 38 | | 6with the industry trade associations, before requiring any new regulatory guidance, regulation, |
---|
39 | 39 | | 7interpretation, program letter or memorandum, or any other materials used in surveyor training to |
---|
40 | 40 | | 8survey licensed providers. |
---|
41 | 41 | | 9 The process, training, and education shall include, but not be limited to, the following: 2 of 2 |
---|
42 | 42 | | 10 (1) annual training for long term care facilities on the licensure and certification process. |
---|
43 | 43 | | 11This training shall include, but not be limited to, the department’s interpretation of the general |
---|
44 | 44 | | 12laws, rules, regulations, procedures, and policies concerning the licensure and certification |
---|
45 | 45 | | 13process for such long-term care facilities; |
---|
46 | 46 | | 14 (2) biannual training of long-term care providers on the most frequently cited |
---|
47 | 47 | | 15deficiencies, identified deficiency trends, both state and federal, and best practices to ensure |
---|
48 | 48 | | 16resident quality of care; and |
---|
49 | 49 | | 17 (3) training of long-term care providers and the department survey inspectors jointly on |
---|
50 | 50 | | 18the department's new expectations; and |
---|
51 | 51 | | 19 Training shall be interactive, with the sharing of information and recommendations |
---|
52 | 52 | | 20between long term care facilities and the department on issues and topics. |
