2727 An Act to ensure senior care organization quality and accountability.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Section 9D of chapter 118E of the General Laws, as appearing in the 2020 Official
3131 2Edition, is hereby amended by inserting, after paragraph (6) of subsection (e), the following
3232 3paragraph:-
3333 4 (7) In contracting with a nursing home licensed under section 71 of chapter 111 of the
3434 5General Laws, any MassHealth Senior Care Options program with which the MassHealth agency
3535 6contracts to provide and coordinate services on a capitated basis shall reimburse the nursing
3636 7home for care and services provided to a MassHealth member at an amount no less than the
3737 8Medicaid fee-for-service payments rates established in 101 CMR 206: Standard Payments to
3838 9Nursing Facilities; provided, however, that such reimbursement payments shall include room and
3939 10board and all rate add-ons specified pursuant to 101 CMR 206, for the purposes of ensuring
4040 11access to critical services and to facilitate transitions from hospitals to nursing facilities.
