| 30 | 30 | | 1 Chapter 118E of the General Laws is hereby amended by inserting after section 79 the |

| 32 | 32 | | 3 Section 80. (a) The secretary of health and human services shall promulgate regulations |

| 33 | 33 | | 4that provide for rate adjustment and reimbursement within 90 days for any residential care home |

| 34 | 34 | | 5or rest home that hires licensed nursing staff to address increased clinical needs of their residents. |

| 35 | 35 | | 6 (b) The secretary of health and human services shall promulgate regulations that provide |

| 36 | 36 | | 7for rate adjustment and reimbursement within 90 days of implementing plans of correction for |
|---|
| 37 | 37 | | 8any residential care home or rest home subject to mandated improvements per department of |

| 38 | 38 | | 9public health certification and licensure surveys. |
