2727 An Act relative to the removal and disposal of waste oil.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Section 52A of chapter 21 of the General Laws, as appearing in the 2020
3131 2Official Edition, is hereby amended by inserting at the end thereof the following new paragraph:-
3232 3 No entity shall accept waste oil or petroleum products for disposal from any automobile
3333 4service station marina serving powered watercraft or retail outlet selling automobile lubricating
3434 5oil in the Commonwealth unless and until such entity has submitted a plan for the removal and
3535 6proper disposal of such materials with the Department of Environmental Protection, and a copy
3636 7of said plan has been provided to any party providing such materials for disposal. Said plan shall
3737 8include, but not be limited to; the methodology for collecting and transporting the waste oil,
3838 9location where the waste oil is to be disposed, and procedures for processing and/or disposing of 2 of 2
3939 10the waste oil. Any person or entity that violates the provisions of this section shall be liable for a
4040 11civil penalty of not more than $1,000 for each offense.
