2525 An Act relative to community behavioral health centers.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 32A of the general laws, as appearing in the 2020 official edition,
2929 2is hereby amended by inserting after section 30 the following new section:-
3030 3 Section 31. (a) For the purposes of this section, the following words shall have the
3131 4following meanings:
3232 5 “Behavioral health bundled services”, services delivered by a community behavioral
3333 6health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
3434 7evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
3535 8mental health, developmental or substance use disorder, provided that services are reimbursed
3636 9through a flat rate per encounter.
3737 10 “Community Behavioral Health Centers”, a clinic licensed by the department of public
3838 11health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00. 2 of 5
3939 12 (b) Any health plan offered by the commission shall provide to an active or retired
4040 13employee of the commonwealth who is insured under the group insurance commission benefits
4141 14on a nondiscriminatory basis for medically necessary behavioral health bundled services
4242 15delivered through community behavioral health centers.
4343 16 SECTION 2. Chapter 175 of the general laws, as appearing in the 2020 official edition, is
4444 17hereby amended by inserting after section 47PP the following new section:-
4545 18 Section 47QQ. (a) For the purposes of this section, the following words shall have the
4646 19following meanings:
4747 20 “Behavioral health bundled services”, services delivered by a community behavioral
4848 21health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
4949 22evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
5050 23mental health, developmental or substance use disorder, provided that services are reimbursed
5151 24through a flat rate per encounter.
5252 25 “Community Behavioral Health Centers”, a clinic licensed by the department of public
5353 26health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
5454 27 (b) Any individual policy of accident and sickness insurance issued pursuant to section
5555 28108, which provides hospital expense and surgical expense insurance, and a group blanket or
5656 29general policy of accident and sickness insurance issued pursuant to section 110, which provides
5757 30hospital expense and surgical expense insurance, which is issued or renewed within or without
5858 31the commonwealth, shall provide benefits on a nondiscriminatory basis for medically necessary
5959 32behavioral health bundled services delivered through community behavioral health centers. 3 of 5
6060 33 SECTION 3. Chapter 176A of the general laws, as appearing in the 2020 official edition,
6161 34is hereby amended by inserting after section 38 the following new section:-
6262 35 Section 39. (a) For the purposes of this section, the following words shall have the
6363 36following meanings:
6464 37 “Behavioral health bundled services”, services delivered by a community behavioral
6565 38health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
6666 39evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
6767 40mental health, developmental or substance use disorder, provided that services are reimbursed
6868 41through a flat rate per encounter.
6969 42 “Community Behavioral Health Centers”, a clinic licensed by the department of public
7070 43health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
7171 44 (b) Any contract between a subscriber and the corporation under an individual or group
7272 45hospital service plan which is issued or renewed within or without the commonwealth shall
7373 46provide benefits on a nondiscriminatory basis for medically necessary behavioral health bundled
7474 47services delivered through community behavioral health centers.
7575 48 SECTION 4. Chapter 176B of the general laws, as appearing in the 2020 official edition,
7676 49is hereby amended by inserting after section 25 the following new section:-
7777 50 Section 26. (a) For the purposes of this section, the following words shall have the
7878 51following meanings:
7979 52 “Behavioral health bundled services”, services delivered by a community behavioral
8080 53health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the 4 of 5
8181 54evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
8282 55mental health, developmental or substance use disorder, provided that services are reimbursed
8383 56through a flat rate per encounter.
8484 57 “Community Behavioral Health Centers”, a clinic licensed by the department of public
8585 58health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
8686 59 (b) Any subscription certificate under an individual or group medical service agreement
8787 60which is issued or renewed within or without the commonwealth shall provide benefits on a
8888 61nondiscriminatory basis for medically necessary behavioral health bundled services delivered
8989 62through community behavioral health centers.
9090 63 SECTION 5. Chapter 176G of the general laws, as appearing in the 2020 official edition,
9191 64is hereby amended by inserting after section the following new section 33:-
9292 65 Section 34. (a) For the purposes of this section, the following words shall have the
9393 66following meanings:
9494 67 “Behavioral health bundled services”, services delivered by a community behavioral
9595 68health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
9696 69evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
9797 70mental health, developmental or substance use disorder, provided that services are reimbursed
9898 71through a flat rate per encounter.
9999 72 “Community Behavioral Health Centers”, a clinic licensed by the department of public
100100 73health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00. 5 of 5
101101 74 (b) Any health maintenance contract issued or renewed within or without the
102102 75commonwealth shall provide benefits on a nondiscriminatory basis for medically necessary
103103 76behavioral health bundled services delivered through community behavioral health centers.
