25	25	An Act relative to community behavioral health centers.
26	26	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
27	27	of the same, as follows:
28	28	1 SECTION 1. Chapter 32A of the general laws, as appearing in the 2020 official edition,
29	29	2is hereby amended by inserting after section 30 the following new section:-
30	30	3 Section 31. (a) For the purposes of this section, the following words shall have the
31	31	4following meanings:
32	32	5 “Behavioral health bundled services”, services delivered by a community behavioral
33	33	6health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
34	34	7evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
35	35	8mental health, developmental or substance use disorder, provided that services are reimbursed
36	36	9through a flat rate per encounter.
37	37	10 “Community Behavioral Health Centers”, a clinic licensed by the department of public
38	38	11health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00. 2 of 5
39	39	12 (b) Any health plan offered by the commission shall provide to an active or retired
40	40	13employee of the commonwealth who is insured under the group insurance commission benefits
41	41	14on a nondiscriminatory basis for medically necessary behavioral health bundled services
42	42	15delivered through community behavioral health centers.
43	43	16 SECTION 2. Chapter 175 of the general laws, as appearing in the 2020 official edition, is
44	44	17hereby amended by inserting after section 47PP the following new section:-
45	45	18 Section 47QQ. (a) For the purposes of this section, the following words shall have the
46	46	19following meanings:
47	47	20 “Behavioral health bundled services”, services delivered by a community behavioral
48	48	21health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
49	49	22evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
50	50	23mental health, developmental or substance use disorder, provided that services are reimbursed
51	51	24through a flat rate per encounter.
52	52	25 “Community Behavioral Health Centers”, a clinic licensed by the department of public
53	53	26health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
54	54	27 (b) Any individual policy of accident and sickness insurance issued pursuant to section
55	55	28108, which provides hospital expense and surgical expense insurance, and a group blanket or
56	56	29general policy of accident and sickness insurance issued pursuant to section 110, which provides
57	57	30hospital expense and surgical expense insurance, which is issued or renewed within or without
58	58	31the commonwealth, shall provide benefits on a nondiscriminatory basis for medically necessary
59	59	32behavioral health bundled services delivered through community behavioral health centers. 3 of 5
60	60	33 SECTION 3. Chapter 176A of the general laws, as appearing in the 2020 official edition,
61	61	34is hereby amended by inserting after section 38 the following new section:-
62	62	35 Section 39. (a) For the purposes of this section, the following words shall have the
63	63	36following meanings:
64	64	37 “Behavioral health bundled services”, services delivered by a community behavioral
65	65	38health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
66	66	39evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
67	67	40mental health, developmental or substance use disorder, provided that services are reimbursed
68	68	41through a flat rate per encounter.
69	69	42 “Community Behavioral Health Centers”, a clinic licensed by the department of public
70	70	43health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
71	71	44 (b) Any contract between a subscriber and the corporation under an individual or group
72	72	45hospital service plan which is issued or renewed within or without the commonwealth shall
73	73	46provide benefits on a nondiscriminatory basis for medically necessary behavioral health bundled
74	74	47services delivered through community behavioral health centers.
75	75	48 SECTION 4. Chapter 176B of the general laws, as appearing in the 2020 official edition,
76	76	49is hereby amended by inserting after section 25 the following new section:-
77	77	50 Section 26. (a) For the purposes of this section, the following words shall have the
78	78	51following meanings:
79	79	52 “Behavioral health bundled services”, services delivered by a community behavioral
80	80	53health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the 4 of 5
81	81	54evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
82	82	55mental health, developmental or substance use disorder, provided that services are reimbursed
83	83	56through a flat rate per encounter.
84	84	57 “Community Behavioral Health Centers”, a clinic licensed by the department of public
85	85	58health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
86	86	59 (b) Any subscription certificate under an individual or group medical service agreement
87	87	60which is issued or renewed within or without the commonwealth shall provide benefits on a
88	88	61nondiscriminatory basis for medically necessary behavioral health bundled services delivered
89	89	62through community behavioral health centers.
90	90	63 SECTION 5. Chapter 176G of the general laws, as appearing in the 2020 official edition,
91	91	64is hereby amended by inserting after section the following new section 33:-
92	92	65 Section 34. (a) For the purposes of this section, the following words shall have the
93	93	66following meanings:
94	94	67 “Behavioral health bundled services”, services delivered by a community behavioral
95	95	68health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
96	96	69evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
97	97	70mental health, developmental or substance use disorder, provided that services are reimbursed
98	98	71through a flat rate per encounter.
99	99	72 “Community Behavioral Health Centers”, a clinic licensed by the department of public
100	100	73health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00. 5 of 5
101	101	74 (b) Any health maintenance contract issued or renewed within or without the
102	102	75commonwealth shall provide benefits on a nondiscriminatory basis for medically necessary
103	103	76behavioral health bundled services delivered through community behavioral health centers.
