2525 An Act relative to telehealth parity for nutrition counseling.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Section 30 of chapter 32A of the General Laws, as inserted by section 3 of
2929 2chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
3030 3“behavioral health services” the following definition:-
3131 4 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
3232 5therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
3333 6nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
3434 7 SECTION 2. Said section 30 of said chapter 32A of the General Laws, as inserted by
3535 8section 3 of chapter 260 of the acts of 2020, is hereby further amended by striking out subsection
3636 9(g) and inserting in place thereof the following subsection:-
3737 10 (g) The commission shall ensure that the rate of payment for in-network providers of
3838 11behavioral health services and in-network providers of nutrition counseling delivered via
3939 12interactive audio-video technology and audio-only telephone shall be no less than the rate of 2 of 6
4040 13payment for the same service delivered via in-person methods; provided, that this subsection
4141 14shall apply to providers of behavioral health services and nutrition counseling covered as
4242 15required under subclause (i) of clause (4) of the second sentence of subsection (a) of section 6 of
4343 16chapter 176O.
4444 17 SECTION 3. Section 79 of chapter 118E of the General Laws, as inserted by section 40
4545 18of chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
4646 19“behavioral health services” the following definition:-
4747 20 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
4848 21therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
4949 22nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
5050 23 SECTION 4. Said section 79 of said chapter 118E of the General Laws, as inserted by
5151 24section 40 of chapter 260 of the acts of 2020, is hereby further amended by striking out
5252 25subsection (g) and inserting in place thereof the following subsection:-
5353 26 (g) The division shall ensure that the rate of payment for in-network providers of
5454 27behavioral health services and in-network providers of nutrition counseling delivered via
5555 28interactive audio-video technology and audio-only telephone shall be no less than the rate of
5656 29payment for the same service delivered via in-person methods; provided, that this subsection
5757 30shall apply to providers of behavioral health services and providers of nutrition counseling
5858 31covered as required under subclause (i) of clause (4) of the second sentence of subsection (a) of
5959 32section 6 of chapter 176O. 3 of 6
6060 33 SECTION 5. Subsection (a) of section 47MM of chapter 175 of the General Laws, as
6161 34inserted by section 47 of chapter 260 of the acts of 2020, is hereby amended by inserting after
6262 35the definition for “behavioral health services” the following definition:-
6363 36 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
6464 37therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
6565 38nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
6666 39 SECTION 6. Said section 47MM of said chapter 175 of the General Laws, as inserted by
6767 40section 40 of chapter 260 of the acts of 2020, is hereby further amended by striking out
6868 41subsection (g) and inserting in place thereof the following subsection:-
6969 42 (g) Insurance companies organized under this chapter shall ensure that the rate of
7070 43payment for in-network providers of behavioral health services and in-network providers of
7171 44nutrition counseling delivered via interactive audio-video technology and audio-only telephone
7272 45shall be no less than the rate of payment for the same service delivered via in-person methods;
7373 46provided, that this subsection shall apply to providers of behavioral health services and providers
7474 47of nutrition counseling covered as required under subclause (i) of clause (4) of the second
7575 48sentence of subsection (a) of section 6 of chapter 176O.
7676 49 SECTION 7. Section 38 of chapter 176A of the General Laws, as inserted by section 49
7777 50of chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
7878 51“behavioral health services” the following definition:-
7979 52 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
8080 53therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
8181 54nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws. 4 of 6
8282 55 SECTION 8. Said section 38 of said chapter 176A of the General Laws, as inserted by
8383 56section 40 of chapter 260 of the acts of 2020, is hereby further amended by striking out
8484 57subsection (g) and inserting in place thereof the following subsection:-
8585 58 (g) Hospital service corporations shall ensure that the rate of payment for in-network
8686 59providers of behavioral health services and in-network providers of nutrition counseling
8787 60delivered via interactive audio-video technology and audio-only telephone shall be no less than
8888 61the rate of payment for the same service delivered via in-person methods; provided, that this
8989 62subsection shall apply to providers of behavioral health services and providers of nutrition
9090 63counseling covered as required under subclause (i) of clause (4) of the second sentence of
9191 64subsection (a) of section 6 of chapter 176O.
9292 65 SECTION 9. Section 25 of chapter 176B of the General Laws, as inserted by section 51
9393 66of chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
9494 67“behavioral health services” the following definition:-
9595 68 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
9696 69therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
9797 70nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
9898 71 SECTION 10. Said section 25 of said chapter 176B of the General Laws, as inserted by
9999 72section 40 of chapter 260 of the acts of 2020, is hereby further amended by striking out
100100 73subsection (g) and inserting in place thereof the following subsection:-
101101 74 (g) Medical service corporations shall ensure that the rate of payment for in-network
102102 75providers of behavioral health services and in-network providers of nutrition counseling
103103 76delivered via interactive audio-video technology and audio-only telephone shall be no less than 5 of 6
104104 77the rate of payment for the same service delivered via in-person methods; provided, that this
105105 78subsection shall apply to providers of behavioral health services and providers of nutrition
106106 79counseling covered as required under subclause (i) of clause (4) of the second sentence of
107107 80subsection (a) of section 6 of chapter 176O.
108108 81 SECTION 11. Section 33 of chapter 176G of the General Laws, as inserted by section 51
109109 82of chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
110110 83“behavioral health services” the following definition:-
111111 84 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
112112 85therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
113113 86nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
114114 87 SECTION 12. Said section 33 of chapter 176G of the General Laws, as inserted by
115115 88section 40 of chapter 260 of the acts of 2020, is hereby further amended by striking out
116116 89subsection (g) and inserting in place thereof the following subsection:-
117117 90 (g) Health maintenance organizations shall ensure that the rate of payment for in-
118118 91network providers of behavioral health services and in-network providers of nutrition counseling
119119 92delivered via interactive audio-video technology and audio-only telephone shall be no less than
120120 93the rate of payment for the same service delivered via in-person methods; provided, that this
121121 94subsection shall apply to providers of behavioral health services and providers of nutrition
122122 95counseling covered as required under subclause (i) of clause (4) of the second sentence of
123123 96subsection (a) of section 6 of chapter 176O. 6 of 6
124124 97 SECTION 13. Section 13 of chapter 176I of the General Laws, as inserted by section 51
125125 98of chapter 260 of the acts of 2020, is hereby amended by inserting after the definition for
126126 99“behavioral health services” the following definition:-
127127 100 “Nutrition counseling”, care and services, including, but not limited to, medical nutrition
128128 101therapy, provided by a dietitian/nutritionist licensed by the board of registration of dietitians and
129129 102nutritionists pursuant to sections 201 to 210, inclusive, of chapter 112 of the General Laws.
130130 103 SECTION 14. Said section 13 of chapter 176I of the General Laws, as inserted by section
131131 10440 of chapter 260 of the acts of 2020, is hereby further amended by striking out subsection (g)
132132 105and inserting in place thereof the following subsection:-
133133 106 (g) Organizations shall ensure that the rate of payment for in-network providers of
134134 107behavioral health services and in-network providers of nutrition counseling delivered via
135135 108interactive audio-video technology and audio-only telephone shall be no less than the rate of
136136 109payment for the same service delivered via in-person methods; provided, that this subsection
137137 110shall apply to providers of behavioral health services and providers of nutrition counseling
138138 111covered as required under subclause (i) of clause (4) of the second sentence of subsection (a) of
139139 112section 6 of chapter 176O.
