28 | 28 | | 1 SECTION 1. Chapter 94G of the General Laws is hereby amended by inserting after |

29 | 29 | | 2Section 21, the following section:- |

30 | 30 | | 3 Section 22. (a) The commission shall collect, compile, and make available to the public |
---|
31 | 31 | | 4on its open data website, from independent testing laboratories as defined in Section 15 the |
---|
32 | 32 | | 5following information, but not limited to, (a) the industry average for: (i) failure rates for |
---|
33 | 33 | | 6pesticides; (ii) failure rates for heavy metals; (iii) failure rates for microbiological contaminants; |
---|
34 | 34 | | 7(iv) failure rates for residual solvents; (v) failure rates for mycotoxins; (vi) moisture content for |
---|
35 | 35 | | 8flowers (vii) THC and THCA for flowers; (viii) THC and THCA for vapes; (ix) THC and THCA |
---|
36 | 36 | | 9for concentrates; (x) total terpenes for flowers; (xi) total terpenes for concentrates; and (xii) total |

37 | 37 | | 10terpenes for vapes; (b) per licensed lab, the average for: (i) failure rates for pesticides; (ii) failure |

46 | 46 | | 19 (c) The commission shall investigate and publicly report the reason for the discrepancy |

47 | 47 | | 20for individual laboratories that are statistically significant outliers in terms of their testing results. |

48 | 48 | | 21 (d) The commission shall promulgate regulations in accordance with this section no later |
---|
49 | 49 | | 22than one year after the effective. |
