2525 An Act relative to data transparency in the cannabis industry.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 94G of the General Laws is hereby amended by inserting after
2929 2Section 21, the following section:-
3030 3 Section 22. (a) The commission shall collect, compile, and make available to the public
3131 4on its open data website, from independent testing laboratories as defined in Section 15 the
3232 5following information, but not limited to, (a) the industry average for: (i) failure rates for
3333 6pesticides; (ii) failure rates for heavy metals; (iii) failure rates for microbiological contaminants;
3434 7(iv) failure rates for residual solvents; (v) failure rates for mycotoxins; (vi) moisture content for
3535 8flowers (vii) THC and THCA for flowers; (viii) THC and THCA for vapes; (ix) THC and THCA
3636 9for concentrates; (x) total terpenes for flowers; (xi) total terpenes for concentrates; and (xii) total
3737 10terpenes for vapes; (b) per licensed lab, the average for: (i) failure rates for pesticides; (ii) failure
3838 11rates for heavy metals; (iii) failure rates for microbiological contaminants; (iv) failure rates for
3939 12residual solvents; (v) failure rates for mycotoxins; (vi) moisture content for flowers; (vii) THC
4040 13and THCA for flowers; (viii) THC and THCA for vapes; (ix) THC and THCA for concentrates; 2 of 2
4141 14(x) total terpenes for flowers; (xi) total terpenes for concentrates; and (xii) total terpenes for
4242 15vapes.
4343 16 (b) The open data website shall include all laboratory data listed in subsection(a) that was
4444 17submitted to the commission prior to enactment. The open data website shall be updated and
4545 18published on a quarterly basis detailing information from the preceding quarter.
4646 19 (c) The commission shall investigate and publicly report the reason for the discrepancy
4747 20for individual laboratories that are statistically significant outliers in terms of their testing results.
4848 21 (d) The commission shall promulgate regulations in accordance with this section no later
4949 22than one year after the effective.
