2525 An Act relative to access to care for serious mental illness.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Chapter 175 of the General Laws is hereby amended by inserting after
2929 2section 47PP the following new section:-
3030 3 Section 47QQ.
3131 4 (a) Any policy, contract, agreement, plan, or certificate of insurance issued, delivered, or
3232 5renewed within the commonwealth, which is considered creditable coverage under section 1 of
3333 6chapter 118M, shall provide coverage for medications used to prevent, assess, or treat serious
3434 7mental illness without requiring prior authorization or the initiation or completion of a step
3535 8therapy protocol.
3636 9 (b) For the purposes of this section, the following terms shall have the following
3737 10meanings unless the context clearly requires otherwise:
3838 11 "Serious mental illness" a mental disorder, as defined in the most recent edition of the
3939 12Diagnostic and Statistical Manual of Mental Disorders published by the American Psychiatric 2 of 4
4040 13Association, that results in serious functional impairment that substantially interferes with or
4141 14limits one or more major life activities.
4242 15 SECTION 2. Chapter 176A of the General Laws is hereby amended by inserting after
4343 16section 8QQ the following new section:-
4444 17 Section 8RR.
4545 18 (a) Any policy, contract, agreement, plan, or certificate of insurance issued, delivered, or
4646 19renewed within the commonwealth, which is considered creditable coverage under section 1 of
4747 20chapter 118M, shall provide coverage for medications used to prevent, assess, or treat serious
4848 21mental illness without requiring prior authorization or the initiation or completion of a step
4949 22therapy protocol.
5050 23 (b) For the purposes of this section, the following terms shall have the following
5151 24meanings unless the context clearly requires otherwise:
5252 25 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
5353 26the Diagnostic and Statistical Manual of Mental Disorders published by the American
5454 27Psychiatric Association, that results in serious functional impairment that substantially interferes
5555 28with or limits one or more major life activities.
5656 29 SECTION 3. Chapter 176B of the General Laws is hereby amended by inserting after
5757 30section 4QQ the following new section:-
5858 31 Section 4RR.
5959 32 (a) Any policy, contract, agreement, plan, or certificate of insurance issued, delivered, or
6060 33renewed within the commonwealth, which is considered creditable coverage under section 1 of 3 of 4
6161 34chapter 118M, shall provide coverage for medications used to prevent, assess, or treat serious
6262 35mental illness without requiring prior authorization or the initiation or completion of a step
6363 36therapy protocol.
6464 37 (b) For the purposes of this section, the following terms shall have the following
6565 38meanings unless the context clearly requires otherwise:
6666 39 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
6767 40the Diagnostic and Statistical Manual of Mental Disorders published by the American
6868 41Psychiatric Association, that results in serious functional impairment that substantially interferes
6969 42with or limits one or more major life activities.
7070 43 SECTION 4. Chapter 176G of the General Laws is hereby amended by inserting after
7171 44section 4I the following new section:-
7272 45 Section 4J.
7373 46 (a) Any policy, contract, agreement, plan, or certificate of insurance issued, delivered, or
7474 47renewed within the commonwealth, which is considered creditable coverage under section 1 of
7575 48chapter 118M, shall provide coverage for medications used to prevent, assess, or treat serious
7676 49mental illness without requiring prior authorization or the initiation or completion of a step
7777 50therapy protocol.
7878 51 (b) For the purposes of this section, the following terms shall have the following
7979 52meanings unless the context clearly requires otherwise:
8080 53 "Serious mental illness" means a mental disorder, as defined in the most recent edition of
8181 54the Diagnostic and Statistical Manual of Mental Disorders published by the American 4 of 4
8282 55Psychiatric Association, that results in serious functional impairment that substantially interferes
8383 56with or limits one or more major life activities.
