2828 An Act regarding Medicare savings programs eligibility.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Section 25A of Chapter 118E of the General Laws is hereby amended by
3232 2replacing Section 25A with the following section:-
3333 3 SECTION 25A. The division shall disregard income in an amount equivalent to one-
3434 4hundred-sixty-five percent (165%) of the federal poverty level, as adjusted annually, in
3535 5determining eligibility for the Qualified Medicare Beneficiary, Specified Low-Income Medicare
3636 6Beneficiary and Qualified Individual programs, described in 42 U.S.C. ยง1396(a)(10)(E) and also
3737 7known as the Medicare Savings or Medicare Buy-In Programs in the year in which the state plan
3838 8amendment is approved; 2 of 2
3939 9 The division shall not apply an asset test in determining eligibility for said Medicare
4040 10Savings Programs;
4141 11 The division shall implement a waiting list in any year in which the number of qualified
4242 12applicants for the Qualified Individual Program exceeds the annual block grant amount for said
4343 13program;
4444 14 The division shall submit a state plan amendment to implement this section no later than
4545 1530 days after the effective date of this section and subsequently promulgate all regulations
4646 16necessary to implement said income and asset disregards.
