28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
29 | 29 | | of the same, as follows: |
---|
30 | 30 | | 1 SECTION 1. Prior to the adoption, amendment, or repeal of any healthcare or health |
---|
31 | 31 | | 2insurance related regulation, an agency must file with the secretary of state’s office a public |
---|
32 | 32 | | 3notice of the proposed action and include a premium impact statement. In the statement, the |
---|
33 | 33 | | 4agency must consider the impact the proposed action will or will not have on health insurance |
---|
34 | 34 | | 5premium rates in Massachusetts. The agency must afford the public an opportunity to present |
---|
35 | 35 | | 6data, views, or arguments related to the impact statement, and prior to adopting the proposed |
---|
36 | 36 | | 7regulation, the agency must file an amended premium impact statement with the secretary of |
---|
37 | 37 | | 8state’s office. |
---|
38 | 38 | | 9 SECTION 2. Any joint committee, house committee or senate committee may report |
---|
39 | 39 | | 10favorably any bill or petition relative to health care or health insurance so long as that bill or 2 of 2 |
---|
40 | 40 | | 11petition shall have first received a premium impact statement conducted by the center for health |
---|
41 | 41 | | 12information and analysis. Any joint committee, house committee or senate committee shall refer |
---|
42 | 42 | | 13all healthcare and health insurance related bills or petitions to an accompanied study order |
---|
43 | 43 | | 14pending a final report by the center for health information and analysis pursuant to this section. |
