| 28 | 28 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

| 29 | 29 | | of the same, as follows: |

| 30 | 30 | | 1 Nothwithstanding any general or special rule to the contrary to the maximum extent |
|---|
| 31 | 31 | | 2allowed by federal law a Multiple Employer Welfare Arrangement or Association Health Plan |
|---|
| 32 | 32 | | 3shall be allowed to operate in the Commonwealth, provided that it meets the following |
|---|
| 33 | 33 | | 4requirements: |
|---|
| 34 | 34 | | 5 1. The arrangement shall at all times be in compliance with federal law and regulation, |
|---|
| 35 | 35 | | 6including but not limited to the US Department of Labor’s regulations regarding Association |
|---|
| 36 | 36 | | 7Health Plans. |
|---|
| 37 | 37 | | 8 2. The arrangement’s governing documents shall require the arrangement to be |

| 38 | 38 | | 9actuarially sound, and the arrangement shall in fact be actuarially sound. 2 of 2 |
