2727 An Act relative to association health plans.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Nothwithstanding any general or special rule to the contrary to the maximum extent
3131 2allowed by federal law a Multiple Employer Welfare Arrangement or Association Health Plan
3232 3shall be allowed to operate in the Commonwealth, provided that it meets the following
3333 4requirements:
3434 5 1. The arrangement shall at all times be in compliance with federal law and regulation,
3535 6including but not limited to the US Department of Labor’s regulations regarding Association
3636 7Health Plans.
3737 8 2. The arrangement’s governing documents shall require the arrangement to be
3838 9actuarially sound, and the arrangement shall in fact be actuarially sound. 2 of 2
3939 10 3. The arrangement shall be conducted in accordance with (insert citation to state rules
4040 11regarding fraud, trade practices, and other behavioral requirements).
