30 | 30 | | 1 SECTION 1. Notwithstanding any general or special law to the contrary, the Secretary of |

31 | 31 | | 2Health and Human Services in conjunction with the Secretary of Elder Affairs shall file an |

32 | 32 | | 3application to seek a waiver with the Center for Medicaid and Medicare Services (CMS) to |
---|
33 | 33 | | 4amend the Commonwealth of Massachusetts’ 1915(c) elderly waiver, and that any program of |
---|
34 | 34 | | 5home and community based services in which family members are permitted to serve as paid |
---|
35 | 35 | | 6caregivers, funded pursuant to Section 9 of Chapter 118E shall include spouses within the |
---|
36 | 36 | | 7definition of a family member. |
