2727 An Act relative to spouses as caregivers.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Notwithstanding any general or special law to the contrary, the Secretary of
3131 2Health and Human Services in conjunction with the Secretary of Elder Affairs shall file an
3232 3application to seek a waiver with the Center for Medicaid and Medicare Services (CMS) to
3333 4amend the Commonwealth of Massachusetts’ 1915(c) elderly waiver, and that any program of
3434 5home and community based services in which family members are permitted to serve as paid
3535 6caregivers, funded pursuant to Section 9 of Chapter 118E shall include spouses within the
3636 7definition of a family member.
