2727 An Act relative to reforming the housing development incentive program.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Section 1 of Chapter 40V of the General Laws, as appearing in the 2020
3131 2Official Edition, is hereby amended by inserting after the word "units" the following words:- ",
3232 3and not less than 20 per cent affordable: (i) rental units for persons whose income is not more
3333 4than 50 per cent of the area median income; or (ii) owner-occupied units for persons whose
3434 5income is not more than 80 per cent of the area median income."
3535 6 SECTION 2. Section 4 of Chapter 40V of the General Laws, as appearing in the 2020
3636 7Official Edition, is hereby amended by inserting after the words "market rate units", the
3737 8following words:- "and not less than 20 per cent affordable: (A) rental units for persons whose
3838 9income is not more than 50 per cent of the area median income; or (B) owner-occupied units for
3939 10persons whose income is not more than 80 per cent of the area median income." 2 of 2
4040 11 SECTION 3. Section 5 of said Chapter 40V, as appearing in the 2020 Official Edition, is
4141 12hereby amended by inserting after the word "rate", in both times it appears, the following words:-
4242 13"and affordable."
