3030 Resolve providing for an investigation and study by a special commission relative to children
3131 and adolescents with intensive behavioral health needs.
3232 1 Resolved, that a special commission is hereby established for the purposes of making an
3333 2investigation and study relative to children and adolescents with intensive behavioral health
3434 3needs whose behavioral health needs, such as acute aggressive, assaultive or otherwise unsafe
3535 4behaviors, are not adequately addressed through inpatient psychiatric hospitalizations,
3636 5Community Based Acute Treatment (CBAT) services, or existing residential or community
3737 6treatment models contracted by the Department of Children and Families.
3838 7 The Commission shall consist of 23 members or their designees:
3939 8 the Secretary of Health and Human Services or a designee, who shall serve as chair;
4040 9 the Commissioner of Public Health or a designee;
4141 10 the Commissioner of the Department of Children and Families or a designee;
4242 11 the Commissioner of the Department of Youth Services or a designee; 2 of 3
4343 12 the Commissioner of the Department of Early Education and Care or a designee;
4444 13 Chief Justice of the Juvenile Court Department or a designee;
4545 14 the Chairs of the Joint Committee on Mental Health, Substance Use and Recovery or
4646 15their designees;
4747 16 the Chairs of the Joint Committee on Children, Families and Persons with Disabilities or
4848 17their designees;
4949 18 a representative from the Office of the Child Advocate;
5050 19 a representative from the Association for Behavioral Healthcare, Inc.;
5151 20 a representative from the Massachusetts Health & Hospital Association;
5252 21 a representative from the Children’s Mental Health Campaign;
5353 22 a representative from the Children’s League of Massachusetts;
5454 23 a representative from the Parent/Professional Advocacy League;
5555 24 a representative from the Massachusetts Behavioral Health Partnership;
5656 25 6 members to be appointed by the chair,
5757 26 2 of whom shall be a family member of a child or adolescent with behavioral health
5858 27needs or who has been involved in the juvenile court system;
5959 28 3 of whom shall be a behavioral health provider specializing in serving children and
6060 29adolescents with intensive behavioral health needs; and 3 of 3
6161 30 1 of whom shall be a clinician or researcher with expertise related to children and
6262 31adolescents with intensive behavioral health needs.
6363 32 In making appointments, the Secretary shall, to the maximum extent feasible, ensure that
6464 33the Commission represents a broad distribution of diverse perspectives and geographic regions.
6565 34 The Commission shall: (i) create aggregate demographic and geographic profiles of
6666 35children and adolescents with intensive behavioral health needs; (ii) examine the current
6767 36availability of, and barriers to providing, behavioral health services and treatment to children and
6868 37adolescents with intensive behavioral health needs; (iii) examine existing efforts undertaken by
6969 38healthcare providers and the existing body of research around best practices for treating children
7070 39and adolescents with intensive behavioral health needs; including, but not limited to models that
7171 40promote community involvement and diversion from the juvenile court system; and (iv) examine
7272 41other matters deemed appropriate by the Commission.
7373 42 All appointments shall be made not later than 30 days after the effective date of this
7474 43resolve.
7575 44 The Commission shall submit its findings and recommendations to the Clerks of the
7676 45Senate and the House of Representatives, the Joint Committee on Mental Health, Substance Use
7777 46and Recovery, the Joint Committee on Children, Families and Persons with Disabilities and the
7878 47Senate and House Committees on Ways and Means not later than January 1, 2024. The Secretary
7979 48of Health and Human Services shall make the report publicly available on the website of the
8080 49Executive Office of Health and Human Services.
