2626 An Act preserving access to treatment for patients with serious mental illnesses.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Section 1 of Chapter 176O of the Massachusetts general laws is hereby
3030 2amended by inserting therein the following new definition: -
3131 3 “Serious mental illness,” any of the following conditions, as defined by the most recent
3232 4edition of the Diagnostic and Statistical Manual of Mental Disorders:
3333 5 (1) Bipolar disorders, hypomanic, manic, depressive, and mixed.
3434 6 (2) Childhood and adolescent depression.
3535 7 (3) Major depressive disorders, single episode or recurrent.
3636 8 (4) Obsessive-compulsive disorders.
3737 9 (5) Paranoid personality disorder and other psychotic disorders.
3838 10 (6) Schizo-affective disorders, bipolar or depressive. 2 of 3
3939 11 (7) Schizophrenia.
4040 12 (8) Post-traumatic stress disorder.
4141 13 SECTION 2. Section 12A of said Chapter 176O is hereby further amended by inserting
4242 14after subsection (g) the following new subsection:-
4343 15 (h) Notwithstanding any other provision of law, a carrier or utilization review
4444 16organization shall not, with respect to a drug approved by the Food and Drug Administration for
4545 17the treatment of serious mental illness, impose a prior authorization requirement, step therapy
4646 18protocol, or any other protocol that could restrict or delay the dispensing of the drug.
4747 19 SECTION 3. Section 8 of Chapter 118E of the Massachusetts general laws is hereby
4848 20amended by inserting therein the following new definition: -
4949 21 i½. “Serious mental illness”, any of the following conditions, as defined by the most
5050 22recent edition of the Diagnostic and Statistical Manual of Mental Disorders:
5151 23 (1) Bipolar disorders, hypomanic, manic, depressive, and mixed.
5252 24 (2) Childhood and adolescent depression.
5353 25 (3) Major depressive disorders, single episode or recurrent.
5454 26 (4) Obsessive-compulsive disorders.
5555 27 (5) Paranoid personality disorder and other psychotic disorders.
5656 28 (6) Schizo-affective disorders, bipolar or depressive.

5858 30 (8) Post-traumatic stress disorder.
5959 31 SECTION 4. Section 51A of said chapter 118E is hereby further amended by inserting
6060 32after subsection (f) the following new subsection: -
6161 33 (g) Notwithstanding any other provision of law, the division or an entity with which the
6262 34division contracts to provide or manage health insurance benefits shall not, with respect to a drug
6363 35approved by the Food and Drug Administration for the treatment of serious mental illness,
6464 36impose a prior authorization requirement, step therapy protocol, or any other protocol that could
6565 37restrict or delay the dispensing of the drug.
