2626 An Act to remove barriers to patient care.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 175 of the General Laws, as appearing in the 2022 Official Edition,
3030 2is hereby amended by inserting after section 47UU the following section:-
3131 3 Section 47VV. When any provision in this chapter requires a diagnostic evaluation,
3232 4medical necessity determination, certification, written order, prescription, or treatment
3333 5recommendation by an attending, treating or consulting physician as a condition of coverage or
3434 6reimbursement of health services, that requirement may be fulfilled by an advanced practice
3535 7registered nurse practicing under section 80B of chapter 112. Nothing in this section shall be
3636 8construed to expand the scope of practice of advanced practice registered nurses.
3737 9 SECTION 2. Chapter 176A of the General Laws, as so appearing, is hereby amended by
3838 10inserting after section 8VV the following section:-
3939 11 Section 8WW. When any provision in this chapter requires a diagnostic evaluation,
4040 12medical necessity determination, certification, written order, prescription, or treatment 2 of 3
4141 13recommendation by an attending, treating or consulting physician as a condition of coverage or
4242 14reimbursement of health services, that requirement may be fulfilled by an advanced practice
4343 15registered nurse practicing under section 80B of chapter 112. Nothing in this section shall be
4444 16construed to expand the scope of practice of advanced practice registered nurses.
4545 17 SECTION 3. Chapter 176B of the General Laws, as so appearing, is hereby amended by
4646 18inserting after section 4VV the following section:-
4747 19 Section 4WW. When any provision in this chapter requires a diagnostic evaluation,
4848 20medical necessity determination, certification, written order, prescription, or treatment
4949 21recommendation by an attending, treating or consulting physician as a condition of coverage or
5050 22reimbursement of health services, that requirement may be fulfilled by an advanced practice
5151 23registered nurse practicing under section 80B of chapter 112. Nothing in this section shall be
5252 24construed to expand the scope of practice of advanced practice registered nurses.
5353 25 SECTION 4. Chapter 176G of the General Laws, as so appearing, is hereby amended by
5454 26inserting after section 4NN the following section:-
5555 27 Section 4OO. When any provision in this chapter requires a diagnostic evaluation,
5656 28medical necessity determination, certification, written order, prescription, or treatment
5757 29recommendation by an attending, treating or consulting physician as a condition of coverage or
5858 30reimbursement of health services, that requirement may be fulfilled by an advanced practice
5959 31registered nurse practicing under section 80B of chapter 112. Nothing in this section shall be
6060 32construed to expand the scope of practice of advanced practice registered nurses. 3 of 3
6161 33 SECTION 5. Subsection (a) of section 16 of chapter 176O of the General Laws, as so
6262 34appearing, is hereby amended by inserting after the word “physician”, in line 1, the following
6363 35words:- “or advanced practice registered nurse”.
6464 36 SECTION 6. Said subsection (a) of section 16 of chapter 176O of the General Laws, as
6565 37so appearing, is hereby further amended by striking out, in line 9, the words “treating physician”
6666 38and inserting in place thereof the following words:- “treating provider”.
6767 39 SECTION 7. Subsection (b) of section 16 of chapter 176O of the General Laws, as so
6868 40appearing, is hereby amended by inserting after the words “treating physician”, in line 11, the
6969 41following words:- “, treating advanced practice registered nurse”.
