27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

28 | 28 | | of the same, as follows: |

29 | 29 | | 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2024 Official |
---|
30 | 30 | | 2Edition, is hereby amended by inserting after section 17S a new section:- |
---|
31 | 31 | | 3 Section 17T. (a) For the purpose of this section, “detransition-related treatment” shall |
---|
32 | 32 | | 4mean any form of medical, psychological, or psychiatric treatment, including but not limited to |
---|
33 | 33 | | 5mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an |
---|
34 | 34 | | 6individual cope with the effects of prior gender-affirming health care services, defined pursuant |
---|
35 | 35 | | 7to Section 1 of Chapter 9A. |
---|
36 | 36 | | 8 (b) Any coverage offered by the commission to an active or retired employee of the |
---|
37 | 37 | | 9commonwealth insured under the group insurance commission that covers gender-affirming |
---|
38 | 38 | | 10health care services, defined pursuant to Section 1 of Chapter 9A, shall provide coverage for |
---|
39 | 39 | | 11detransition-related treatment. The benefits in this section shall not be subject to any greater 2 of 4 |
---|
40 | 40 | | 12deductible, coinsurance, copayments or out-of-pocket limits than any other benefit provided by |
---|
41 | 41 | | 13the commission. |
---|
42 | 42 | | 14 SECTION 2: Chapter 118E of the General Laws, as appearing in the 2024 Official |
---|
43 | 43 | | 15Edition, is hereby amended by inserting after section 10Q a new section:- |
---|
44 | 44 | | 16 Section 10R. (a) For the purpose of this section, “detransition-related treatment” shall |
---|
45 | 45 | | 17mean any form of medical, psychological, or psychiatric treatment, including but not limited to |
---|
46 | 46 | | 18mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an |
---|
47 | 47 | | 19individual cope with the effects of prior gender-affirming health care services, defined pursuant |
---|
48 | 48 | | 20to Section 1 of Chapter 9A. |
---|
49 | 49 | | 21 (b) The division and its contracted health insurers, health plans, health maintenance |
---|
50 | 50 | | 22organizations, behavioral health management firms and third-party administrators under contract |
---|
51 | 51 | | 23to a Medicaid managed care organization or primary care clinician plan shall provide coverage |
---|
52 | 52 | | 24under all benefit plans that cover gender-affirming health care services, defined pursuant to |
---|
53 | 53 | | 25Section 1 of Chapter 9A, for detransition-related treatments. |
---|
54 | 54 | | 26 SECTION 3. Chapter 175 of the General Laws, as appearing in the 2024 Official Edition, |
---|
55 | 55 | | 27is hereby amended by inserting after section 47UU a new section:- |

56 | 56 | | 28 Section 47VV. (a) For the purpose of this section, “detransition-related treatment” shall |
---|
57 | 57 | | 29mean any form of medical, psychological, or psychiatric treatment, including but not limited to |
---|
58 | 58 | | 30mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an |
---|
59 | 59 | | 31individual cope with the effects of prior gender-affirming health care services, defined pursuant |
---|
60 | 60 | | 32to Section 1 of Chapter 9A. 3 of 4 |
---|
61 | 61 | | 33 (b) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or |
---|
62 | 62 | | 34renewed within the commonwealth, which is considered creditable coverage under section 1 of |
---|
63 | 63 | | 35chapter 111M, and which covers gender-affirming health care services, defined pursuant to |
---|
64 | 64 | | 36Section 1 of Chapter 9A, shall provide coverage for detransition-related treatment. |
---|
65 | 65 | | 37 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2024 Official |
---|
66 | 66 | | 38Edition, is hereby amended by inserting a new section:- |
---|
67 | 67 | | 39 Section 39. (a) For the purpose of this section, “detransition-related treatment” shall mean |
---|
68 | 68 | | 40any form of medical, psychological, or psychiatric treatment, including but not limited to mental- |
---|
69 | 69 | | 41health treatment, medical interventions, and surgeries, that stops, reverses, or helps an individual |
---|
70 | 70 | | 42cope with the effects of prior gender-affirming health care services, defined pursuant to Section 1 |

71 | 71 | | 43of Chapter 9A. |

72 | 72 | | 44 (b) Any contract between a subscriber and the corporation under an individual or group |
---|
73 | 73 | | 45hospital service plan that is delivered, issued or renewed within the commonwealth and that |

74 | 74 | | 46covers gender-affirming health care services, defined pursuant to Section 1 of Chapter 9A, shall |
---|
75 | 75 | | 47provide coverage for detransition-related treatments. |

76 | 76 | | 48 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2024 Official |
---|
77 | 77 | | 49Edition, is hereby amended by inserting a new section:- |

78 | 78 | | 50 Section 26. (a) For the purpose of this section, “detransition-related treatment” shall mean |

79 | 79 | | 51any form of medical, psychological, or psychiatric treatment, including but not limited to mental- |
