2626 An Act relative to insurance coverage for new treatment.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 32A of the General Laws, as appearing in the 2024 Official
3030 2Edition, is hereby amended by inserting after section 17S a new section:-
3131 3 Section 17T. (a) For the purpose of this section, “detransition-related treatment” shall
3232 4mean any form of medical, psychological, or psychiatric treatment, including but not limited to
3333 5mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an
3434 6individual cope with the effects of prior gender-affirming health care services, defined pursuant
3535 7to Section 1 of Chapter 9A.
3636 8 (b) Any coverage offered by the commission to an active or retired employee of the
3737 9commonwealth insured under the group insurance commission that covers gender-affirming
3838 10health care services, defined pursuant to Section 1 of Chapter 9A, shall provide coverage for
3939 11detransition-related treatment. The benefits in this section shall not be subject to any greater 2 of 4
4040 12deductible, coinsurance, copayments or out-of-pocket limits than any other benefit provided by
4141 13the commission.
4242 14 SECTION 2: Chapter 118E of the General Laws, as appearing in the 2024 Official
4343 15Edition, is hereby amended by inserting after section 10Q a new section:-
4444 16 Section 10R. (a) For the purpose of this section, “detransition-related treatment” shall
4545 17mean any form of medical, psychological, or psychiatric treatment, including but not limited to
4646 18mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an
4747 19individual cope with the effects of prior gender-affirming health care services, defined pursuant
4848 20to Section 1 of Chapter 9A.
4949 21 (b) The division and its contracted health insurers, health plans, health maintenance
5050 22organizations, behavioral health management firms and third-party administrators under contract
5151 23to a Medicaid managed care organization or primary care clinician plan shall provide coverage
5252 24under all benefit plans that cover gender-affirming health care services, defined pursuant to
5353 25Section 1 of Chapter 9A, for detransition-related treatments.
5454 26 SECTION 3. Chapter 175 of the General Laws, as appearing in the 2024 Official Edition,
5555 27is hereby amended by inserting after section 47UU a new section:-
5656 28 Section 47VV. (a) For the purpose of this section, “detransition-related treatment” shall
5757 29mean any form of medical, psychological, or psychiatric treatment, including but not limited to
5858 30mental-health treatment, medical interventions, and surgeries, that stops, reverses, or helps an
5959 31individual cope with the effects of prior gender-affirming health care services, defined pursuant
6060 32to Section 1 of Chapter 9A. 3 of 4
6161 33 (b) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
6262 34renewed within the commonwealth, which is considered creditable coverage under section 1 of
6363 35chapter 111M, and which covers gender-affirming health care services, defined pursuant to
6464 36Section 1 of Chapter 9A, shall provide coverage for detransition-related treatment.
6565 37 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2024 Official
6666 38Edition, is hereby amended by inserting a new section:-
6767 39 Section 39. (a) For the purpose of this section, “detransition-related treatment” shall mean
6868 40any form of medical, psychological, or psychiatric treatment, including but not limited to mental-
6969 41health treatment, medical interventions, and surgeries, that stops, reverses, or helps an individual
7070 42cope with the effects of prior gender-affirming health care services, defined pursuant to Section 1
7171 43of Chapter 9A.
7272 44 (b) Any contract between a subscriber and the corporation under an individual or group
7373 45hospital service plan that is delivered, issued or renewed within the commonwealth and that
7474 46covers gender-affirming health care services, defined pursuant to Section 1 of Chapter 9A, shall
7575 47provide coverage for detransition-related treatments.
7676 48 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2024 Official
7777 49Edition, is hereby amended by inserting a new section:-
7878 50 Section 26. (a) For the purpose of this section, “detransition-related treatment” shall mean
7979 51any form of medical, psychological, or psychiatric treatment, including but not limited to mental-
8080 52health treatment, medical interventions, and surgeries, that stops, reverses, or helps an individual
8181 53cope with the effects of prior gender-affirming health care services, defined pursuant to Section 1
8282 54of Chapter 9A. 4 of 4
8383 55 (b) Any subscription certificate under an individual or group medical service agreement
8484 56delivered, issued or renewed within the commonwealth that covers gender-affirming health care
8585 57services, defined pursuant to Section 1 of Chapter 9A, shall provide coverage for detransition-
8686 58related treatments.
8787 59 SECTION 6. Chapter 176G of the General Laws, as appearing in the 2024 Official
8888 60Edition, is hereby amended by inserting a new section:-
8989 61 Section 34. (a) For the purpose of this section, “detransition-related treatment” shall mean
9090 62any form of medical, psychological, or psychiatric treatment, including but not limited to mental-
9191 63health treatment, medical interventions, and surgeries, that stops, reverses, or helps an individual
9292 64cope with the effects of prior gender-affirming health care services, defined pursuant to Section 1
9393 65of Chapter 9A.
9494 66 (b) An individual or group health maintenance contract that is issued or renewed and that
9595 67covers gender-affirming health care services, defined pursuant to Section 1 of Chapter 9A, shall
9696 68provide coverage for detransition-related treatments.
