2727 An Act relative to ATM receipts.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 Section 9 of chapter 167B of the General Laws, as appearing in the 2022 Official Edition,
3131 2is hereby amended by striking out subsection (a) and inserting in place thereof the following
3232 3subsection:-
3333 4 (a) For each electronic fund transfer initiated by a consumer from an electronic branch or
3434 5point-of-sale terminal, the financial institution holding such consumer's account shall, directly or
3535 6indirectly at the time the transfer is initiated, make available to the consumer written
3636 7documentation of such transfer. The documentation shall clearly set forth to the extent
3737 8applicable:
3838 9 (1) the amount involved and the calendar date the transfer is initiated; 2 of 2
3939 10 (2) the type of transfer and the type of the consumer's account or accounts with the
4040 11financial institution from which or to which funds are transferred;
4141 12 (3) a number or code that uniquely identifies the consumer initiating the transfer, the
4242 13consumer's account or accounts, or the access device used to initiate the transfer;
4343 14 (4) the identity of any third party to whom or from whom funds are transferred;
4444 15 (5) the location or identification of the electronic branch or point-of-sale terminal
4545 16involved;
4646 17 (6) a transfer identification number which provides a permanent audit trail; and
4747 18 (7) a list of contact information for the consumer, if the consumer may be experiencing
4848 19financial abuse, which shall include, but not limited to:
4949 20 (i) the financial institution holding the consumer’s account;
5050 21 (ii) a non-profit that provides advice and support involving financial management;
5151 22 (iii) the national domestic violence hotline;
5252 23 (iv) the Massachusetts behavioral health help line;
5353 24 (v) the Attorney General’s office; and
5454 25 (vi) 911 if the consumer is in immediate danger.
5555 26 The information required to be disclosed under clauses (4), (5) and (7) of this subsection
5656 27shall be provided in readily understandable language or capable of being explained in readily
5757 28understandable language.
