2626 An Act assuring prompt access to health care.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 32A of the General Laws is hereby amended by adding at the end
3030 2the following new section:
3131 3 Section 28: Reimbursement of costs for medically appropriate evaluation and
3232 4management services in outpatient settings, including but not limited to office- and hospital-
3333 5based clinics, in accordance with guidelines developed by the division of insurance, shall be part
3434 6of a basic benefits package offered by the insurer or a third party and shall not require a
3535 7deductible; provided, however, that deductibles shall be required if the applicable plan is
3636 8governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result
3737 9of the prohibition on deductibles for these services.
3838 10 SECTION 2. Chapter 32B of the General Laws is hereby amended by adding at the end
3939 11the following new section: 2 of 3
4040 12 Section 30: Reimbursement of costs for medically appropriate evaluation and
4141 13management services in outpatient settings, including but not limited to office- and hospital-
4242 14based clinics, in accordance with guidelines developed by the division of insurance, shall be part
4343 15of a basic benefits package offered by the insurer or a third party and shall not require a
4444 16deductible; provided, however, that deductibles shall be required if the applicable plan is
4545 17governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result
4646 18of the prohibition on deductibles for these services.
4747 19 SECTION 3. Chapter 175 of the General Laws is hereby amended by inserting the
4848 20following section:-
4949 21 Section 47LL: Reimbursement of costs for medically appropriate evaluation and
5050 22management services in outpatient settings, including but not limited to office- and hospital-
5151 23based clinics, in accordance with guidelines developed by the division of insurance, shall be part
5252 24of a basic benefits package offered by the insurer or a third party and shall not require a
5353 25deductible; provided, however, that deductibles shall be required if the applicable plan is
5454 26governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result
5555 27of the prohibition on deductibles for these services.
5656 28 SECTION 4. Chapter 176A of the General Laws is hereby amended by inserting the
5757 29following section:-
5858 30 Section 8NN: Reimbursement of costs for medically appropriate evaluation and
5959 31management services in outpatient settings, including but not limited to office- and hospital-
6060 32based clinics, in accordance with guidelines developed by the division of insurance, shall be part
6161 33of a basic benefits package offered by the insurer or a third party and shall not require a 3 of 3
6262 34deductible; provided, however, that deductibles shall be required if the applicable plan is
6363 35governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result

6565 37 SECTION 5. Chapter 176B of the General Laws is hereby amended by inserting the
6666 38following section:-
6767 39 Section 4NN: Reimbursement of costs for medically appropriate evaluation and
6868 40management services in outpatient settings, including but not limited to office- and hospital-
6969 41based clinics, in accordance with guidelines developed by the division of insurance, shall be part
7070 42of a basic benefits package offered by the insurer or a third party and shall not require a
7171 43deductible; provided, however, that a deductible shall be required if the applicable plan is
7272 44governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result
7373 45of the prohibition on deductibles for these services.
7474 46 SECTION 6. Chapter 176G of the General Laws is hereby amended by inserting the
7575 47following new section 33:-
7676 48 Section 33: Reimbursement of costs for medically appropriate evaluation and
7777 49management services in outpatient settings, including but not limited to office- and hospital-
7878 50based clinics, in accordance with guidelines developed by the division of insurance, shall be part
7979 51of a basic benefits package offered by the insurer or a third party and shall not require a
8080 52deductible; provided, however, that a deductible shall be required if the applicable plan is
8181 53governed by the Federal Internal Revenue Code and would lose its tax-exempt status as a result
8282 54of the prohibition on deductibles for these services.
