2626 An Act relative to insurance coverage for medically necessary tattoos.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 175 of the General Laws is hereby amended by inserting after Section 47UU the
3030 2following section:
3131 3 Section 47VV. (a) For the purposes of this section, the following term shall have the
3232 4following meaning unless the context clearly requires otherwise:
3333 5 “medical tattoo”, a medically necessary tattoo used to restore the appearance of a
3434 6patient’s skin, conceal surface defects, or mark the treatment site of a patient.
3535 7 (b) Any policy, contract, agreement, plan or certificate of insurance issued, delivered or
3636 8renewed within or without the commonwealth shall provide coverage for medical tattoos when
3737 9deemed medically necessary by a physician. The commissioner shall promulgate regulations to
3838 10implement this section.
