29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. Notwithstanding any laws to the contrary, all residents of the |
---|
32 | 32 | | 2Commonwealth over the age of 65 with an adjusted gross household income of $50,000 annually |
---|
33 | 33 | | 3or less, are eligible for a prescription drug rebate. |
---|
34 | 34 | | 4 SECTION 2. All prescription drugs, as defined in Section 1 of Chapter 94C of the |
---|
35 | 35 | | 5General Laws, are eligible for the rebate program. |
---|
36 | 36 | | 6 SECTION 3. Rebate shall be defined as a reimbursement for the total out of pocket |
---|
37 | 37 | | 7expenses, including insurance co-pays, incurred by an eligible individual for prescription drugs. |
---|
38 | 38 | | 8Rebates shall be disbursed to eligible individuals from the General Fund. 2 of 2 |
---|
39 | 39 | | 9 SECTION 4 .The Commissioner shall prescribe the process by which an eligible |
---|
40 | 40 | | 10individual shall file for a rebate. |
---|
41 | 41 | | 11 SECTION 5. Rebates shall not exceed $2,500 per individual annually |
---|
42 | 42 | | 12 SECTION 6. The Commissioner shall report on the impact of this rebate program to the |
---|
43 | 43 | | 13Committees of Ways & Means and the Joint Committee on Health Care Financing on an annual |
---|
44 | 44 | | 14basis, commencing one year from the date the program goes into effect. |

45 | 45 | | 15 SECTION 7. This rebate program shall expire four years from the date of effect unless |
---|
46 | 46 | | 16reauthorized by the legislature. |
