25	25	An Act relative to capping the price of epinephrine.
26	26	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
27	27	of the same, as follows:
28	28	1 SECTION 1. Subsection (b) of section 26 of chapter 342 of the Acts of 2024, is hereby
29	29	2amended by inserting after the word “members”, the following words:- ; and the following acute
30	30	3condition (i) anaphylaxis.
31	31	4 SECTION 2. Subsection (c) of said section 26 of said chapter 342, as so appearing, is
32	32	5hereby amended by inserting after the word “diabetes”, the following words:- and epinephrine
33	33	6delivered via an autoinjector as the drug used to treat anaphylaxis.
34	34	7 SECTION 3. Said subsection (c) of said section 26 of said chapter 342, as so appearing,
35	35	8is hereby further amended by inserting after the word “condition”, the following words:- or acute
36	36	9condition.
37	37	10 SECTION 4. Said clause (v) of said subsection (c) of said section 26 of said chapter 342,
38	38	11as so appearing, is hereby further amended by inserting after the word “condition”, the following
39	39	12words:- or acute condition. 2 of 6
40	40	13 SECTION 5. Subsection (d) of said section 26 of said chapter 342, as so appearing, is
41	41	14hereby amended by adding the following sentence:- Coverage for 1 brand name of epinephrine
42	42	15delivered via an autoinjector or 1 generic brand of epinephrine delivered via an autoinjector shall
43	43	16not be subject to any deductible or co-insurance and any co-payment shall not exceed $60 for a
44	44	17two-pack of epinephrine autoinjectors.
45	45	18 SECTION 6. Subsection (b) of section 28 of chapter 342 of the Acts of 2024, is hereby
46	46	19amended by inserting after the word “enrollees”, the following words:- ; and the following acute
47	47	20condition (i) anaphylaxis.
48	48	21 SECTION 7. Subsection (c) of said section 28 of said chapter 342, as so appearing, is
49	49	22hereby amended by inserting after the word “diabetes”, the following words:- and epinephrine
50	50	23delivered via an autoinjector as the drug used to treat anaphylaxis.
51	51	24 SECTION 8. Said subsection (c) of said section 28 of said chapter 342, as so appearing,
52	52	25is hereby further amended by inserting after the word “condition”, the following words:- or acute

54	54	27 SECTION 9. Said clause (v) of said subsection (c) of said section 28 of said chapter 342,
55	55	28as so appearing, is hereby further amended by inserting after the word “condition”, the following

57	57	30 SECTION 10. Subsection (d) of said section 28 of said chapter 342, as so appearing, is
58	58	31hereby amended by adding the following sentence:- Coverage for 1 brand name of epinephrine
59	59	32delivered via an autoinjector or 1 generic brand of epinephrine delivered via an autoinjector shall
60	60	33not be subject to any deductible or co-insurance and any co-payment shall not exceed $60 for a

62	62	35 SECTION 11. Subsection (b) of section 31 of chapter 342 of the Acts of 2024, is hereby
63	63	36amended by inserting after the word “enrollees”, the following words:- ; and the following acute
64	64	37condition (i) anaphylaxis.
65	65	38 SECTION 12. Subsection (c) of said section 31 of said chapter 342, as so appearing, is
66	66	39hereby amended by inserting after the word “diabetes”, the following words:- and epinephrine
67	67	40delivered via an autoinjector as the drug used to treat anaphylaxis.

116	116	89 SECTION 27. Subsection (c) of said section 35 of said chapter 342, as so appearing, is
117	117	90hereby amended by inserting after the word “diabetes”, the following words:- and epinephrine

128	128	101not be subject to any deductible or co-insurance and any co-payment shall not exceed $60 for a

130	130	103 SECTION 31. This act shall apply to all contracts entered into, renewed or amended on
131	131	104or after July 1, 2026.
