27	27	An Act relative to maintenance of certification.
28	28	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
29	29	of the same, as follows:
30	30	1 SECTION 1. Paragraph (b) of Section 15 of Chapter 6D of the General laws, is hereby
31	31	2amended by inserting at the end thereof the following new text:
32	32	3 ; and (xi) That the ACO shall not require a physician to secure a Maintenance of
33	33	4Certification (MOC) as qualifying for membership, credentialing or otherwise receiving
34	34	5participating in the ACO or receiving reimbursement for medical services provided. For the
35	35	6purposes of this paragraph, "Maintenance of Certification (MOC)" shall mean a continuing
36	36	7education program measuring core competencies in the practice of medicine and surgery and
37	37	8approved by a nationally-recognized accrediting organization.
38	38	9 SECTION 2. Chapter 111 is hereby amended by adding Section 51C1/2 as follows: 2 of 4
39	39	10 Each hospital, or other institution, licensed under section fifty-one shall not require a
40	40	11physician to secure a Maintenance of Certification (MOC) as when considering or acting on an
41	41	12application for employment or staff membership or clinical privileges to practice. For the
42	42	13purposes of this paragraph, "Maintenance of Certification (MOC)" shall mean a continuing
43	43	14education program measuring core competencies in the practice of medicine and surgery and
44	44	15approved by a nationally-recognized accrediting organization.
45	45	16 SECTION 3. Chapter 112; Section 2 is hereby be amended by adding the following new
46	46	17paragraph at the conclusion of the Section:
47	47	18 Nothing in this Chapter shall be construed as to require a physician to secure a
48	48	19Maintenance of Certification (MOC) as a condition of licensure, reimbursement, employment, or
49	49	20admitting privileges at a hospital in this state. For the purposes of this paragraph, "Maintenance
50	50	21of Certification (MOC)" shall mean a continuing education program measuring core
51	51	22competencies in the practice of medicine and surgery and approved by a nationally-recognized
52	52	23accrediting organization.
53	53	24 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2014 Official
54	54	25Edition, is hereby amended by inserting at the end thereof the following new section:
55	55	26 The hospital services corporation medical professional mutual insurance company
56	56	27approved by the commissioner shall not require a physician to secure a Maintenance of
57	57	28Certification (MOC) as qualifying for credentialing or otherwise receiving reimbursement for
58	58	29medical services provided. For the purposes of this paragraph, "Maintenance of Certification
59	59	30(MOC)" shall mean a continuing education program measuring core competencies in the practice
60	60	31of medicine and surgery and approved by a nationally-recognized accrediting organization. 3 of 4
61	61	32 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2014 Official
62	62	33Edition, is hereby amended by inserting at the end thereof the following new section:
63	63	34 The medical services corporation approved by the commissioner shall not require a
64	64	35physician to secure a Maintenance of Certification (MOC) as qualifying for credentialing or
65	65	36otherwise receiving reimbursement for medical services provided. For the purposes of this
66	66	37paragraph, "Maintenance of Certification (MOC)" shall mean a continuing education program
67	67	38measuring core competencies in the practice of medicine and surgery and approved by a
68	68	39nationally-recognized accrediting organization.
69	69	40 SECTION 6. Chapter 176G of the General Laws, as appearing in the 2014 Official
70	70	41Edition, is hereby amended by inserting at the end thereof the following new section:
71	71	42 The health maintenance organization shall not require a physician to secure a
72	72	43Maintenance of Certification (MOC) as qualifying for credentialing or otherwise receiving
73	73	44reimbursement for medical services provided. For the purposes of this paragraph, "Maintenance
74	74	45of Certification (MOC)" shall mean a continuing education program measuring core
75	75	46competencies in the practice of medicine and surgery and approved by a nationally-recognized
76	76	47accrediting organization.
77	77	48 SECTION 7. Chapter 176I of the General Laws, as appearing in the 2014 Official
78	78	49Edition, is hereby amended by inserting at the end thereof the following new section:
79	79	50 Organizations shall not require a physician to secure a Maintenance of Certification
80	80	51(MOC) as qualifying for credentialing or otherwise receiving reimbursement for medical
81	81	52services provided. For the purposes of this paragraph, "Maintenance of Certification (MOC)" 4 of 4
82	82	53shall mean a continuing education program measuring core competencies in the practice of
83	83	54medicine and surgery and approved by a nationally-recognized accrediting organization.
