2727 An Act relative to maintenance of certification.
2828 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2929 of the same, as follows:
3030 1 SECTION 1. Paragraph (b) of Section 15 of Chapter 6D of the General laws, is hereby
3131 2amended by inserting at the end thereof the following new text:
3232 3 ; and (xi) That the ACO shall not require a physician to secure a Maintenance of
3333 4Certification (MOC) as qualifying for membership, credentialing or otherwise receiving
3434 5participating in the ACO or receiving reimbursement for medical services provided. For the
3535 6purposes of this paragraph, "Maintenance of Certification (MOC)" shall mean a continuing
3636 7education program measuring core competencies in the practice of medicine and surgery and
3737 8approved by a nationally-recognized accrediting organization.
3838 9 SECTION 2. Chapter 111 is hereby amended by adding Section 51C1/2 as follows: 2 of 4
3939 10 Each hospital, or other institution, licensed under section fifty-one shall not require a
4040 11physician to secure a Maintenance of Certification (MOC) as when considering or acting on an
4141 12application for employment or staff membership or clinical privileges to practice. For the
4242 13purposes of this paragraph, "Maintenance of Certification (MOC)" shall mean a continuing
4343 14education program measuring core competencies in the practice of medicine and surgery and
4444 15approved by a nationally-recognized accrediting organization.
4545 16 SECTION 3. Chapter 112; Section 2 is hereby be amended by adding the following new
4646 17paragraph at the conclusion of the Section:
4747 18 Nothing in this Chapter shall be construed as to require a physician to secure a
4848 19Maintenance of Certification (MOC) as a condition of licensure, reimbursement, employment, or
4949 20admitting privileges at a hospital in this state. For the purposes of this paragraph, "Maintenance
5050 21of Certification (MOC)" shall mean a continuing education program measuring core
5151 22competencies in the practice of medicine and surgery and approved by a nationally-recognized
5252 23accrediting organization.
5353 24 SECTION 4. Chapter 176A of the General Laws, as appearing in the 2014 Official
5454 25Edition, is hereby amended by inserting at the end thereof the following new section:
5555 26 The hospital services corporation medical professional mutual insurance company
5656 27approved by the commissioner shall not require a physician to secure a Maintenance of
5757 28Certification (MOC) as qualifying for credentialing or otherwise receiving reimbursement for
5858 29medical services provided. For the purposes of this paragraph, "Maintenance of Certification
5959 30(MOC)" shall mean a continuing education program measuring core competencies in the practice
6060 31of medicine and surgery and approved by a nationally-recognized accrediting organization. 3 of 4
6161 32 SECTION 5. Chapter 176B of the General Laws, as appearing in the 2014 Official
6262 33Edition, is hereby amended by inserting at the end thereof the following new section:
6363 34 The medical services corporation approved by the commissioner shall not require a
6464 35physician to secure a Maintenance of Certification (MOC) as qualifying for credentialing or
6565 36otherwise receiving reimbursement for medical services provided. For the purposes of this
6666 37paragraph, "Maintenance of Certification (MOC)" shall mean a continuing education program
6767 38measuring core competencies in the practice of medicine and surgery and approved by a
6868 39nationally-recognized accrediting organization.
6969 40 SECTION 6. Chapter 176G of the General Laws, as appearing in the 2014 Official
7070 41Edition, is hereby amended by inserting at the end thereof the following new section:
7171 42 The health maintenance organization shall not require a physician to secure a
7272 43Maintenance of Certification (MOC) as qualifying for credentialing or otherwise receiving
7373 44reimbursement for medical services provided. For the purposes of this paragraph, "Maintenance
7474 45of Certification (MOC)" shall mean a continuing education program measuring core
7575 46competencies in the practice of medicine and surgery and approved by a nationally-recognized
7676 47accrediting organization.
7777 48 SECTION 7. Chapter 176I of the General Laws, as appearing in the 2014 Official
7878 49Edition, is hereby amended by inserting at the end thereof the following new section:
7979 50 Organizations shall not require a physician to secure a Maintenance of Certification
8080 51(MOC) as qualifying for credentialing or otherwise receiving reimbursement for medical
8181 52services provided. For the purposes of this paragraph, "Maintenance of Certification (MOC)" 4 of 4
8282 53shall mean a continuing education program measuring core competencies in the practice of
8383 54medicine and surgery and approved by a nationally-recognized accrediting organization.
