| 28 | 28 | | of the same, as follows: |

| 29 | 29 | | 1 Chapter 118E of the General Laws is hereby amended by inserting the following new |
|---|
| 30 | 30 | | 2section after section 25A:- |
|---|
| 31 | 31 | | 3 Section 25B. (a) All Medicare, Medicare Advantage, and MassHealth providers and |
|---|
| 32 | 32 | | 4suppliers must not bill Medicare beneficiaries in the Qualified Medicare Beneficiary, also known |
|---|
| 33 | 33 | | 5as QMB, eligibility group for Medicare Part A or Part B cost-sharing pursuant to federal and |
|---|
| 34 | 34 | | 6state law. |
|---|
| 35 | 35 | | 7 (b) Providers who unlawfully bill Medicare beneficiaries in the QMB eligibility group for |
|---|
| 36 | 36 | | 8Medicare cost-sharing including deductibles, co-pays, or co-insurance shall be subject to |
|---|
| 37 | 37 | | 9sanctions pursuant to regulations promulgated by the division within 90 days of this section |
|---|
| 38 | 38 | | 10taking effect. Such sanctions may include but are not limited to monetary fines and shall take |
|---|
| 39 | 39 | | 11account of mitigating circumstances such as clerical errors and good faith mistakes. |
