2626 An Act to protect qualified medicare beneficiaries from improper billing.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 118E of the General Laws is hereby amended by inserting the following new
3030 2section after section 25A:-
3131 3 Section 25B. (a) All Medicare, Medicare Advantage, and MassHealth providers and
3232 4suppliers must not bill Medicare beneficiaries in the Qualified Medicare Beneficiary, also known
3333 5as QMB, eligibility group for Medicare Part A or Part B cost-sharing pursuant to federal and
3434 6state law.
3535 7 (b) Providers who unlawfully bill Medicare beneficiaries in the QMB eligibility group for
3636 8Medicare cost-sharing including deductibles, co-pays, or co-insurance shall be subject to
3737 9sanctions pursuant to regulations promulgated by the division within 90 days of this section
3838 10taking effect. Such sanctions may include but are not limited to monetary fines and shall take
3939 11account of mitigating circumstances such as clerical errors and good faith mistakes.
