2828 An Act relative to instate tuition.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 (a) Section 9 of chapter 15A of the General Laws is hereby amended by adding the
3232 2following paragraph:—
3333 3 Notwithstanding any general or special law to the contrary, for the purpose of
3434 4determining eligibility for in-state tuition rates and fees at public institutions of higher education,
3535 5in the case of an individual who is not a citizen or permanent resident of the United States as
3636 6those terms are defined under federal immigration law, the individual shall not be eligible for in-
3737 7state tuition.
3838 8 (b) Subsection (t) of Section 9 of chapter 15A of the General Laws is hereby further
3939 9amended striking out subsection (t), and inserting in place thereof the following subsection:— 2 of 2
4040 10 (t) issue regulations defining resident of the commonwealth and proof of the same for the
4141 11purpose of admission and tuition expenses of public institutions of higher education and prepare
4242 12uniform proofs of residence to be used by all public institutions; provided, however, for the
4343 13purposes of this clause, a resident of the commonwealth shall also be a citizen or permanent
4444 14resident of the United States, as provided in section 1621 of Title 8 of the United States Code;
4545 15provided further, that insofar as the Massachusetts Maritime Academy is designated a regional
4646 16maritime academy by the United States maritime administration, residents of the states
4747 17comprising the designated region and attending the Massachusetts Maritime Academy shall be
4848 18considered Massachusetts residents for the purposes of admission and tuition;
