2828 An Act requiring the reporting of satisfaction of judgments awarding money damages.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Chapter 218 of the General Laws, as appearing in the 2022 Official Edition,
3232 2is hereby amended by inserting after section 25 the following section:-
3333 3 Section 25A. Any party who obtains a judgment for money damages under the procedure
3434 4shall, within 60 days after full satisfaction of such judgment, file a notice of satisfaction of
3535 5judgment with the court that issued the judgment. Any party who fails to do so may be liable to
3636 6the judgment debtor for any costs and attorneys’ fees awarded on motion in the court's discretion
3737 7that were reasonably incurred in proving that the judgment was satisfied in full. This section
3838 8shall not apply to a judgment that has been satisfied by levy of execution. 2 of 2
3939 9 SECTION 2. Chapter 235 of the General Laws, as so appearing, is hereby amended by
4040 10inserting after section 13 the following section:-
4141 11 Section 13A. Any party who obtains a judgment for money damages shall, within 60 days
4242 12after full satisfaction of such judgment, file a notice of satisfaction of judgment with the court
4343 13that issued the judgment. Any party who fails to do so may be liable to the judgment debtor for
4444 14any costs and attorneys’ fees awarded on motion in the court's discretion that were reasonably
4545 15incurred in proving that the judgment was satisfied in full. This section shall not apply to a
4646 16judgment that has been satisfied by levy of execution.
4747 17 SECTION 3. Chapter 239 of the General Laws, as so appearing, is hereby amended by
4848 18inserting after section 3 the following section:-
4949 19 Section 3A. Any party who obtains a judgment under this chapter that includes money
5050 20damages for rent shall, within 60 days after full satisfaction of such judgment, file a notice of
5151 21satisfaction of judgment with the court that issued the judgment. Any party who fails to do so
5252 22may be liable to the judgment debtor for any costs and attorneys’ fees awarded on motion in the
5353 23court's discretion that were reasonably incurred in proving that the judgment was satisfied in full.
5454 24This section shall not apply to a money judgment that has been satisfied by levy of execution.
