29 | 29 | | 1 SECTION 1. Chapter 268 of the General Laws is hereby amended by adding the |

30 | 30 | | 2following new section: |

31 | 31 | | 3 Section 41. Whoever, having been ordered to wear a GPS tracking device by a court of |
---|
32 | 32 | | 4the Commonwealth or by another Court of competent jurisdiction, as part of a condition of |
---|
33 | 33 | | 5probation or as a condition of pre-trial release, and who intentionally damages, removes, |
---|
34 | 34 | | 6modifies or deactivates said GPS tracking device, or who attempts to damage, remove, modify or |
---|
35 | 35 | | 7deactivate said GPS tracking device, shall be punished by imprisonment by no more than five |
---|
36 | 36 | | 8years or incarceration in the House of Correction by not more than two-and-one half years. |
