2626 An Act relative to GPS tampering.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Chapter 268 of the General Laws is hereby amended by adding the
3030 2following new section:
3131 3 Section 41. Whoever, having been ordered to wear a GPS tracking device by a court of
3232 4the Commonwealth or by another Court of competent jurisdiction, as part of a condition of
3333 5probation or as a condition of pre-trial release, and who intentionally damages, removes,
3434 6modifies or deactivates said GPS tracking device, or who attempts to damage, remove, modify or
3535 7deactivate said GPS tracking device, shall be punished by imprisonment by no more than five
3636 8years or incarceration in the House of Correction by not more than two-and-one half years.
