27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |

28 | 28 | | of the same, as follows: |

29 | 29 | | 1 SECTION 1. Chapter 140 of the General Laws, as appearing in the 2022 Official Edition, |
---|
30 | 30 | | 2is hereby amended by inserting the following:- |
---|
31 | 31 | | 3 Section 131Z. (a) There shall be an Extreme Risk Protection Order study commission, |
---|
32 | 32 | | 4within the executive office of public safety and security, hereinafter referred to as the board, |
---|
33 | 33 | | 5comprised of 7 members: the director of the firearms record bureau within the department of |
---|
34 | 34 | | 6criminal justice information services or designee, who shall serve as chair; the attorney general |
---|
35 | 35 | | 7or designee; 1 member appointed by the speaker of the house of representatives who shall not be |
---|
36 | 36 | | 8a member of the general court and shall have demonstrated knowledge or expertise in firearm |
---|
37 | 37 | | 9safety, law or technology; 1 member appointed by the president of the senate who shall not be a |
---|
38 | 38 | | 10member of the general court and shall have demonstrated knowledge or expertise in firearm |
---|
39 | 39 | | 11safety, law or technology; 1 member appointed by the governor; 1 shall be appointed by the Gun |
---|
40 | 40 | | 12Owners Action League, Inc. and 1 of whom shall be a police chief selected from a list of four 2 of 2 |
---|
41 | 41 | | 13chiefs provided by the Massachusetts Chiefs of Police Association Incorporated; and the armorer |
---|
42 | 42 | | 14of the department of state police or designee. |

43 | 43 | | 15 (b) The board shall examine the effectiveness, frequency and disposition of cases related |

44 | 44 | | 16to, the Commonwealth’s extreme risk protection order law and produce a report of their findings |

45 | 45 | | 17by February 28th of the year following the previous year’s report. The board members shall |
---|
46 | 46 | | 18serve without compensation; provided, however, that members shall be reimbursed for any usual |
---|
47 | 47 | | 19and customary expenses incurred in the performance of their duties. The executive office of |
---|
48 | 48 | | 20public safety and security, in consultation with the board, shall adopt operating rules and |
---|
49 | 49 | | 21procedures for its organization and activities. |
