32 | 32 | | 1 Section 3A of chapter 40A of the General Laws, as appearing in the 2022 Official |

33 | 33 | | 2Edition, is hereby amended by adding the following subsection:- |

34 | 34 | | 3 (d) An MBTA community designated as "adjacent" may submit a written petition to the |
---|
35 | 35 | | 4executive office of housing and livable communities requesting a review of its designation. The |
---|
36 | 36 | | 5petition shall include evidence demonstrating that the designation imposes undue burdens due to |
---|
37 | 37 | | 6a lack of infrastructure or resources to support the requirements of this section. The executive |
---|
38 | 38 | | 7office shall promulgate regulations to establish the criteria and procedures for reviewing such |
---|
39 | 39 | | 8petitions and determining whether a community’s designation should be modified. |
