By Representative Vieira of Falmouth, a petition (accompanied by bill, House, No. 2351) of 
David T. Vieira (by vote of the town) that Barnstable County be authorized to convey land and 
certain interests in land in the town of Bourne to said town. Municipalities and Regional 
Government. [Local Approval Received.]

An Act authorizing the Barnstable County and the town of Bourne to convey land and certain 
interests in land in the town of Bourne.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 SECTION 1. (a) Notwithstanding any general or special law to the contrary and pursuant 
2to the provisions of article 	97 of the amendments to the Massachusetts Constitution, Barnstable 
3county may convey to the town of Bourne property located at 0 County road and 100 Dr. Julius 
4Kelley lane in Bourne and shown as lot 7 on land court plan no. 24204C, including the parcel of 
5land shown as lot 8 on land court plan no. 24204D, subject to the conservation restriction 
6encumbering a portion of said property, which restriction is registered with the Barnstable land 
7court registry district as document #978,790, as amended.
8 (b) Notwithstanding any general or special law to the contrary and pursuant to the 
9provisions of article 97 of the amendments to the Massachusetts Constitution, the town of 
10Bourne, being the holder of the foregoing conservation restriction, may assign or transfer said  2 of 2
11restriction to a qualified entity for the purpose of acquiring from Barnstable county ownership of 
12the property described in subsection (a) above.
13 SECTION 2. This act shall take effect upon its passage.
