2626 An Act relative to chaperones for medical exams.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Chapter 111 of the General Laws, as most recently amended by section 21 of chapter 186
3030 2of the acts of 2024, is hereby further amended by adding the following section:-
3131 3 Section 249. (a) A health care provider, as defined in section 1, shall offer a trained
3232 4chaperone to be physically present for all: (i) genital and rectal examinations regardless of
3333 5gender; and (ii) breast examinations for patients who identify as female.
3434 6 (b) The patient shall have the choice to either accept or decline the presence of a
3535 7chaperone during the examination. A health care provider shall ensure that a chaperone is
3636 8available: (i) before any breast, genital or rectal examination can be performed on the patient;
3737 9and (ii) to act in accordance with the patient’s preference.
3838 10 (c) A health care provider shall ensure that the chaperone is: (i) not a friend or relative of
3939 11the patient; (ii) not a friend or relative of the person performing the medical exam; and (iii)
4040 12licensed by the board of registration in medicine pursuant to section 2 of chapter 112. 2 of 2
4141 13 (d) A chaperone during a breast, genital or rectal examination may not participate in
4242 14actions that would obstruct or distract the chaperone from observing the person providing the
4343 15medical examination's behavior and actions throughout the exam, procedure or clinical
4444 16encounter.
4545 17 (e) The presence or absence of a chaperone for all breast, genital and rectal examinations
4646 18shall be documented in the patient chart.
4747 19 (f) The patient may decline the presence of a chaperone for a breast, genital and rectal
4848 20examination pursuant to subsection (b). If the patient declines, the person providing the medical
4949 21examination may:
5050 22 (i) defer the breast, genital or rectal examination if, in the person providing the medical
5151 23examination’s best judgment that deferring the examination is in the best interest of the patient;
5252 24or
5353 25 (ii) perform the examination and document the patient's consent to proceed without the
5454 26presence of a chaperone.
5555 27 (g) A health care provider shall not be required under this section to offer a chaperone to
5656 28be present in circumstances when it is likely that failure to examine the patient would result in
5757 29significant and imminent harm to the patient, such as during a medical emergency.
5858 30 (i) A health care provider shall not be required under this section to offer a chaperone if a
5959 31chaperone is already present in the normal course of the medical examination.
