2828 An Act prohibiting the requirement of a COVID-19 vaccine, mRNA vaccine, or gene-altering
2929 procedure.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. Chapter 111 of the General Laws, as appearing in the 2022 Official Edition,
3333 2is hereby amended by adding the following section:-
3434 3 Section 245. Notwithstanding any general or special law to the contrary, the
3535 4commonwealth shall not require proof of vaccination against COVID-19, mRNA vaccine, or
3636 5gene-altering procedure as a condition of entry to the Commonwealth.
3737 6 Notwithstanding any general or special law to the contrary, the commonwealth and all of
3838 7its agencies, authorities and political subdivisions shall not require proof of vaccination against
3939 8COVID-19, mRNA vaccine, or gene-altering procedure as a condition of entry to a public
4040 9building.
4141 10 Notwithstanding any general or special law to the contrary, no public or private
4242 11elementary school, secondary school, high school, charter school, college, university or other
4343 12post-secondary institution of higher education shall require proof of vaccination against COVID- 2 of 2
4444 1319, mRNA vaccine, or gene-altering procedure as a condition of enrollment, access to campus or
4545 14attendance in in-person classes.
4646 15 Notwithstanding any general or special law to the contrary, the commonwealth shall not
4747 16require any private business to require proof of vaccination against COVID-19, mRNA vaccine,
4848 17or gene-altering procedure as a condition of entry to the business, or access to employment by
4949 18such business.
5050 19 SECTION 2. The first paragraph of section 92A of chapter 272 of the General Laws, as
5151 20appearing in the 2022 Official Edition, is hereby amended by adding the following sentence:-
5252 21 No owner, lessee, proprietor, manager, superintendent, agent or employee of any place of
5353 22public accommodation, resort or amusement shall, directly or indirectly, by themselves or
5454 23another, require proof of vaccination against COVID-19, mRNA vaccine, or gene-altering
5555 24procedure as a condition of entry to a place of public accommodation, resort or amusement.
