2828 An Act establishing a commission to study the encouragement of organ donation.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Notwithstanding any general or special law to the contrary, there shall be a
3232 2commission to study and provide recommendations on ways to incentivize organ donation.
3333 3 SECTION 2. The commission shall consist of the house and senate chairs of the joint
3434 4committee on health care financing, who shall serve as the co-chairs; one member to be
3535 5appointed by the speaker of the house of representatives; one member to be appointed by the
3636 6president of the senate; one member to be appointed by the house minority leader; one member
3737 7to be appointed by the senate minority leader; the director of the health policy commission or a
3838 8designee; the commissioner of the department of public health or a designee; and the executive
3939 9director of the center for health information and analysis or a designee. 2 of 2
4040 10 SECTION 3. The commission shall study and make recommendations on ways to
4141 11increase voluntary organ donation, including but not limited to examining the implementation of
4242 12an organ donation program with direct or indirect monetary incentives in the commonwealth.
4343 13The commission shall assess various organ donation incentives currently in place in other states.
4444 14 SECTION 4. The commission shall submit its report and findings, along with any
4545 15recommendations and drafted legislation, to the house and senate committees on ways and
4646 16means, the joint committee on health care financing, and the clerks of the house of
4747 17representatives and senate within 12 months of the passage of this act.
