2828 An Act relative to food truck licensure.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 Chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby
3232 2amended by adding the following section:-
3333 3 Section 330. Mobile Food Establishment Licensure
3434 4 For the purposes of this section, the term “mobile food establishment” shall mean a
3535 5vehicle-mounted, self-contained food service operation, such as a food truck, designed to be
3636 6readily moveable and used to store, prepare, display, serve, or sell food. The term “department”
3737 7shall mean the Food Protection Program.
3838 8 The Food Protection Program shall promulgate rules and regulations establishing legal
3939 9standards and responsibilities for mobile food establishments. The department shall be the sole 2 of 2
4040 10authority empowered to issue licenses for the operation of mobile food establishments. Such
4141 11rules and regulations shall include, but not be limited to, the requirement that mobile food
4242 12establishments pass an inspection conducted by the fire department in the municipality in which
4343 13the mobile food establishment has its mailing address. Towns and municipalities may assess a
4444 14fee on mobile food establishments operating in their jurisdiction.
