26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 Chapter 22C of the General Laws is hereby amended by adding the following section:- |
---|
29 | 29 | | 2 Section 74. (a) The colonel may appoint as special state police officers retired uniformed |
---|
30 | 30 | | 3members who, as the colonel deems necessary, may perform police details or any police duties |
---|
31 | 31 | | 4arising therefrom during the course of police detail work, whether or not related to the detail |
---|
32 | 32 | | 5work. |
---|
33 | 33 | | 6 (b) Retired uniformed members appointed as special state police officers under this |
---|
34 | 34 | | 7section shall: |
---|
35 | 35 | | 8 (i) have retired prior to the date of the appointment as a special state police officer; |
---|
36 | 36 | | 9 (ii) have a state police discharge status of honorable; |
---|
37 | 37 | | 10 (iii) be deemed by the colonel necessary, suitable, qualified and fit to perform the same |
---|
38 | 38 | | 11essential functions and duties as uniformed members of the department; 2 of 2 |

39 | 39 | | 12 (iv) be certified by the police officer standards and training commission pursuant to |
---|
40 | 40 | | 13section 4 of chapter 6E; |
---|
41 | 41 | | 14 (v) be subject to or exempt from department rules as determined by the colonel; and |
---|
42 | 42 | | 15 (vi) be equipped, trained and deployed as determined by the colonel. |
---|
43 | 43 | | 16 (c) Appointed retired uniformed members shall, in accordance with sections 91 and 91A |
---|
44 | 44 | | 17of chapter 32, be at-will employees subject to appointment and removal by the colonel in a |
---|
45 | 45 | | 18manner consistent with sections 52 and 53 and shall be appointed for a term of 1 year subject to |
---|
46 | 46 | | 19renewal in the colonel’s sole discretion. Appointed retired uniformed members shall not be |
---|
47 | 47 | | 20subject to the civil service law or rules, shall not be entitled to any benefits of such law or rules, |
---|
48 | 48 | | 21but shall, in the performance of assigned duties and for the purposes of section 9A of chapter |
---|
49 | 49 | | 22258, be deemed a member of the department. |
