2828 An Act relative to access to constitutional rights.
2929 Whereas, The deferred operation of this act would tend to defeat its purpose, which is to
3030 ensure timely constitutional access to acquire a firearms identification card or a license to carry
3131 firearms, therefore it is hereby declared to be an emergency law, necessary for the immediate
3232 preservation of the public convenience.
3333 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3434 of the same, as follows:
3535 1 SECTION 1. Section 129B of Chapter 140 of the General Laws are hereby amended in
3636 2section (2) by deleting the words “provided, however, that the taking of fingerprints shall not be
3737 3required in issuing the renewal of a card if the renewal applicant's fingerprints are on file with
3838 4the department of state police” and inserting in place thereof the following; “provided, however,
3939 5that the taking of fingerprints shall not be required in issuing or renewing a card if the applicant's
4040 6fingerprints are on file with the department of state police or if such situation deemed reasonable 2 of 2
4141 7by the licensing authority or the Executive Office of Public Safety shall prevent such fingerprints
4242 8from being collected.”
4343 9 SECTION 2. Section 129B of Chapter 140 of the General Laws are hereby amended in
4444 10section (7) by deleting the word “, fingerprint”
4545 11 SECTION 3. Section 131 of Chapter 140 of the General Laws are hereby amended in
4646 12section (e) in line 8 by adding after the word “firearms” the following: “,provided, however, that
4747 13the taking of fingerprints shall not be required in issuing or renewing a card if such situation
4848 14deemed reasonable by the licensing authority or the Executive Office of Public Safety shall
4949 15prevent such fingerprints from being collected.”
5050 16 SECTION 4. Section 131 of Chapter 140 of the General Laws are hereby amended in
5151 17section (g) by deleting the word “, fingerprint”
5252 18 SECTION 5. Section 131 of Chapter 140 of the General Laws is hereby amended in
5353 19section (l) by deleting the words “The taking of fingerprints shall not be required in issuing the
5454 20renewal of a license if the renewal applicant's fingerprints are on file with the department of the
5555 21state police.” and inserting in place thereof the following; “The taking of fingerprints shall not be
5656 22required in issuing or renewing a license if the applicant's fingerprints are on file with the
5757 23department of the state police, or if such situation deemed reasonable by the licensing authority
5858 24or the Executive Office of Public Safety shall prevent such fingerprints from being collected.”
