| 27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 28 | 28 | | of the same, as follows: |

| 29 | 29 | | 1 The General Laws are hereby amended in Chapter 40B by inserting after Section 30 the |
|---|
| 30 | 30 | | 2following section:- |

| 31 | 31 | | 3 SECTION 31. (a) As used in this section, the following words shall have the following |

| 33 | 33 | | 5 “Agency”, shall mean the Berkshire Regional Planning Commission, the Central |
|---|
| 34 | 34 | | 6Massachusetts Regional Planning Commission, the Franklin Regional Council of Governments, |
|---|
| 35 | 35 | | 7the Merrimack Valley Planning Commission, the Montachusett Regional Planning Commission, |
|---|
| 36 | 36 | | 8the Northern Middlesex Council of Governments, the Old Colony Planning Council, the Pioneer |
|---|
| 37 | 37 | | 9Valley Planning Commission and the Southeastern Regional Planning and Economic |
|---|
| 38 | 38 | | 10Development District. 2 of 2 |

| 39 | 39 | | 11 (b) Notwithstanding any general or special law to the contrary, an agency that is a |
|---|
| 40 | 40 | | 12member of the state retirement system pursuant to chapter 32 of the General Laws shall be |
|---|
| 41 | 41 | | 13deemed to be or shall continue to be a member of the state retirement system. |
|---|
| 42 | 42 | | 14 (c) An agency shall not be required to annually reimburse the state board of retirement |
|---|
| 43 | 43 | | 15for its pro rata share of any retirement allowance or pension paid by said board during the |
|---|
| 44 | 44 | | 16preceding calendar year which is based on whole or in part on service with such district provided |
|---|
| 45 | 45 | | 17that each agency contributes the required accumulated deductions and interest to the annuity |
|---|
| 46 | 46 | | 18savings accounts of the agency. |
|---|
| 47 | 47 | | 19 (d) An agency shall not be held liable for any past due contributions. |
