2626 An Act providing for special death benefits to fallen public safety officers.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 Section 100 of chapter 32 of the General Laws, as appearing in the 2010 Official Edition,
3030 2is hereby amended by inserting after the word “death”, in line 22, the following words:-
3131 3provided, however, that for the purpose of any payment on or after December 1, 2010 the term
3232 4amount of pension shall in no case be less than the full salary payable to a police officer in the
3333 5next grade-step (in the case of a deceased police officer) or a firefighter in the next grade-step (in
3434 6the case of a deceased firefighter) while employed by a department or uniformed force on the
3535 7date of such employee's death. Provided further that for the purpose of any payment on or after
3636 8December 1, 2010, the term amount of pension shall in no case be less than the earnings that
3737 9would have been payable to a police superior officer were he or she in the next grade-step of a
3838 10supervisory position (in the case of a police superior officer deceased on or after December 1,
3939 112010 who had been appointed to and was serving in such a supervisory position) or payable to a
4040 12fire officer were he or she in the next grade-step of a supervisory position (in the case of a fire
4141 13officer deceased on or after December 1, 2010 who had been appointed to and was serving in 2 of 2
4242 14such a supervisory position) employed by a department or uniformed force on the date of such
4343 15employee's death.
