2828 An Act Authorizing the State Retirement Board to Retire Jamie J. Magarian, a Uniformed
2929 Member of the Department of State Police at the Regular Rate of Compensation.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 SECTION 1. (a) Notwithstanding any general or special law to the contrary, the state
3333 2retirement board shall retire Jamie J. Magarian, a uniformed member of the department of state
3434 3police, who as a result of injuries sustained while in the performance of his duties in March
3535 42018, is totally and permanently incapacitated from performing the essential duties of a
3636 5uniformed member of the department of state police.
3737 6 (b) The annual amount of pension payable to Jamie J. Magarian shall be equal to the
3838 7regular rate of compensation that would have been paid had he continued in service as a
3939 8uniformed member of the department of state police at the grade held by him at the time of his
4040 9retirement until his death or reaching mandatory retirement age, whichever comes first. The
4141 10additional benefits granted in this act shall be funded and administered by the state retirement 2 of 2
4242 11board, consistent with and subject to chapter 32 of the General Laws. All amounts paid under
4343 12this act shall be non-taxable to the extent allowable under state law.
4444 13 (c) Upon attaining the mandatory retirement age for a uniformed member of the
4545 14department of state police, Jamie J. Magarian shall receive a pension pursuant to section 7 of said
4646 15chapter 32, a yearly amount of pension equal to 80 per cent of the annual rate of the
4747 16compensation he was receiving on the day before he reaches the mandatory retirement age for a
4848 17uniformed member of the department of state police of the commonwealth.
4949 18 SECTION 2. Jamie J. Magarian shall be entitled to receive indemnification for all
5050 19hospital, medical and related expenses that have been or may be incurred after the date of his
5151 20retirement as a result of the injuries sustained by him while in the performance of his duties in
5252 21March 2018.
5353 22 SECTION 3. In addition to the benefits granted herein and upon retirement, Jamie J.
5454 23Magarian shall receive a lump sum from the state retirement board equal to his total accumulated
5555 24retirement deductions.
5656 25 SECTION 4. If Jamie J. Magarian is married at the time of retirement, then upon his
5757 26death, should his spouse, survive him, the state retirement board shall pay to her an annuity in the
5858 27amount of 75 per cent of the amount of the pension that otherwise would have been payable to
5959 28him until her death.
6060 29 SECTION 5. This act shall take effect upon its passage.
