29 | 29 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
30 | 30 | | of the same, as follows: |
---|
31 | 31 | | 1 SECTION 1. Chapter 29 of the General Laws, as appearing in the 2022 Official Edition, |
---|
32 | 32 | | 2is hereby amended by adding the following section:- |
---|
33 | 33 | | 3 Section 72. |
---|
34 | 34 | | 4 As used in this section, the following words shall, unless the context clearly requires |
---|
35 | 35 | | 5otherwise, have the following meanings: |
---|
36 | 36 | | 6 “Intentionally-added PFAS”, PFAS chemicals that are added to a product or that enter the |
---|
37 | 37 | | 7product from the manufacturing or processing of the product; provided, however, that the |
---|
38 | 38 | | 8manufacturer of the product knows, or is reasonably expected to know, or possesses or controls |
---|
39 | 39 | | 9information of the addition of PFAS chemicals; and provided further, that “intentionally-added |
---|
40 | 40 | | 10PFAS” shall include any degradation products containing PFAS chemicals or products for which 2 of 3 |
---|
41 | 41 | | 11PFAS chemicals or PFAS precursors are used as a processing agent or mold release agent or |
---|
42 | 42 | | 12PFAS created by chemical reactions. |
---|
43 | 43 | | 13 “Perfluoraolkyl and polyfluoraolkyl substances” or “PFAS chemicals”, a class of |
---|
44 | 44 | | 14fluorinated organic chemicals containing at least 1 fully fluorinated carbon atom. |
---|
45 | 45 | | 15 No state agency or state authority shall provide funding for the purchase, use or |
---|
46 | 46 | | 16installation of artificial turf that contains zinc, plastic, or intentionally-added perfluoroalkyl and |
---|
47 | 47 | | 17polyfluoroalkyl substances for any new or existing field. Any existing artificial turf field |
---|
48 | 48 | | 18containing zinc, plastic, or intentionally-added PFAS chemicals shall be allowed to be used for |
---|
49 | 49 | | 19its useful life but shall not be replaced with artificial turf containing zinc, plastic, or |
---|
50 | 50 | | 20intentionally-added PFAS chemicals. |
---|
51 | 51 | | 21 SECTION 2. Chapter 40 of the General Laws, as so appearing, is hereby amended by |
---|
52 | 52 | | 22adding the following section:- |
