2727 An Act prohibiting state and municipal contracts for the purchase and installation of artificial turf
2828 fields.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Chapter 29 of the General Laws, as appearing in the 2022 Official Edition,
3232 2is hereby amended by adding the following section:-
3333 3 Section 72.
3434 4 As used in this section, the following words shall, unless the context clearly requires
3535 5otherwise, have the following meanings:
3636 6 “Intentionally-added PFAS”, PFAS chemicals that are added to a product or that enter the
3737 7product from the manufacturing or processing of the product; provided, however, that the
3838 8manufacturer of the product knows, or is reasonably expected to know, or possesses or controls
3939 9information of the addition of PFAS chemicals; and provided further, that “intentionally-added
4040 10PFAS” shall include any degradation products containing PFAS chemicals or products for which 2 of 3
4141 11PFAS chemicals or PFAS precursors are used as a processing agent or mold release agent or
4242 12PFAS created by chemical reactions.
4343 13 “Perfluoraolkyl and polyfluoraolkyl substances” or “PFAS chemicals”, a class of
4444 14fluorinated organic chemicals containing at least 1 fully fluorinated carbon atom.
4545 15 No state agency or state authority shall provide funding for the purchase, use or
4646 16installation of artificial turf that contains zinc, plastic, or intentionally-added perfluoroalkyl and
4747 17polyfluoroalkyl substances for any new or existing field. Any existing artificial turf field
4848 18containing zinc, plastic, or intentionally-added PFAS chemicals shall be allowed to be used for
4949 19its useful life but shall not be replaced with artificial turf containing zinc, plastic, or
5050 20intentionally-added PFAS chemicals.
5151 21 SECTION 2. Chapter 40 of the General Laws, as so appearing, is hereby amended by
5252 22adding the following section:-
5353 23 Section 70.
5454 24 “Intentionally-added PFAS”, PFAS chemicals that are added to a product or that enter the
5555 25product from the manufacturing or processing of the product; provided, however, that the
5656 26manufacturer of the product knows, or is reasonably expected to know, or possesses or controls
5757 27information of the addition of PFAS chemicals; and provided further, that “intentionally-added
5858 28PFAS” shall include any degradation products containing PFAS chemicals or products for which
5959 29PFAS chemicals or PFAS precursors are used as a processing agent or mold release agent or
6060 30PFAS created by chemical reactions.
6161 31 “Local government”, a county, city, town or other municipal entity. 3 of 3
6262 32 “Perfluoraolkyl and polyfluoraolkyl substances” or “PFAS chemicals”, a class of
6363 33fluorinated organic chemicals containing at least 1 fully fluorinated carbon atom.
6464 34 No local government shall provide funding for the purchase, use or installation of
6565 35artificial turf that contains zinc, plastic, or intentionally-added perfluoroalkyl and polyfluoroalkyl
6666 36substances for any new or existing field. Any existing artificial turf field containing zinc, plastic,
6767 37or intentionally-added PFAS chemicals shall be allowed to be used for its useful life but shall not
6868 38be replaced with artificial turf containing zinc, plastic, or intentionally-added PFAS chemicals.
