33 | 33 | | Whereas, The deferred operation of this act would tend to defeat its purpose, which is to |
---|
34 | 34 | | authorize forthwith the transfer of certain parcels of land to the city of Framingham, therefore it |
---|
35 | 35 | | is hereby declared to be an emergency law, necessary for the immediate preservation of the |
---|
36 | 36 | | public convenience. |
---|
37 | 37 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
38 | 38 | | of the same, as follows: |
---|
39 | 39 | | 1 SECTION 1. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General |
---|
40 | 40 | | 2Laws or any other general or special law to the contrary, the commissioner of capital asset |
---|
41 | 41 | | 3management and maintenance, in consultation with the court administrator of the trial court, may |
---|
42 | 42 | | 4convey certain adjacent parcels of land in the city of Framingham acquired for the purpose of |
---|
43 | 43 | | 5erecting a building for the First District Court of Southern Middlesex for nominal consideration |
---|
44 | 44 | | 6to the city of Framingham; provided, however, that the commissioner shall not convey said 2 of 2 |
---|
45 | 45 | | 7parcels prior to: (1) the completion of a regional justice center at 121 Union avenue in the city of |
---|
46 | 46 | | 8Framingham and (2) a determination by the commissioner, in consultation with the court |
---|
47 | 47 | | 9administrator of the trial court, that the parcels are surplus to the needs of the trial court. The |
---|
48 | 48 | | 10parcels are located at and known and numbered as 600 and 602 Concord street in the city of |
---|
49 | 49 | | 11Framingham and are further described in deeds recorded in the Middlesex South district registry |
---|
50 | 50 | | 12of deeds in book 7816, page 107 and book 9859, page 328. The parcels shall be conveyed by |
---|
51 | 51 | | 13deed without warranties or representations by the commonwealth and without restrictions on use |
---|
52 | 52 | | 14or future conveyance by the city. The conveyance shall be subject to such additional conditions |
---|
53 | 53 | | 15and restrictions as the commissioner of capital asset management and maintenance, in |
---|
54 | 54 | | 16consultation with the court administrator of the trial court, may determine. The commissioner |
---|
55 | 55 | | 17may, in consultation with the court administrator of the trial court, determine the exact |
---|
56 | 56 | | 18boundaries of the parcels prior to conveyance. |

57 | 57 | | 19 SECTION 2. Notwithstanding any general or special law to the contrary, the city of |
---|
58 | 58 | | 20Framingham shall be responsible for all costs and expenses of any transaction authorized by this |
---|
59 | 59 | | 21act as determined by the commissioner of capital asset management and maintenance, including, |
---|
60 | 60 | | 22but not limited to, the costs of any engineering, surveys, appraisals, title examinations, recording |
---|
61 | 61 | | 23fees and deed preparation. |
