| 27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
|---|
| 28 | 28 | | of the same, as follows: |
|---|
| 29 | 29 | | 1 SECTION 40. (a) By no later than twelve months following enactment of this |
|---|
| 30 | 30 | | 2legislation, each local unit of government shall adopt a land use ordinance or bylaws that: |
|---|
| 31 | 31 | | 3 (1) create an expedited, streamlined permitting process for electric vehicle charging |
|---|
| 32 | 32 | | 4stations, including electric vehicle charging stations installed in the public right-of-way, with |
|---|
| 33 | 33 | | 5binding timeline for the review and approval of permit applications not to exceed thirty days; |
|---|
| 34 | 34 | | 6 (2) classify all levels of electric vehicle charging stations as permitted accessory and |
|---|
| 35 | 35 | | 7primary use in all zoning districts; |
|---|
| 36 | 36 | | 8 (3) address electric vehicle charging in parking minimum requirements, specifically that |
|---|
| 37 | 37 | | 9a parking space served by an electric vehicle charging station or any parking spaces used to site |
|---|
| 38 | 38 | | 10electric vehicle charging equipment must be counted as at least one standard automobile parking |
|---|
| 39 | 39 | | 11space and that any van-accessible parking space shall count as at least two standard automobile 2 of 2 |
|---|
| 40 | 40 | | 12parking spaces for the purpose of complying with any applicable minimum parking |
|---|
| 41 | 41 | | 13requirements; |
|---|
| 42 | 42 | | 14 (4) specify that review of applications to install electric vehicle charging stations, |
|---|
| 43 | 43 | | 15including electric vehicle charging stations installed in the public right-of-way, shall be limited |
|---|
| 44 | 44 | | 16to the building official’s review of whether the installation meets all health and safety |
|---|
| 45 | 45 | | 17requirements under local, state, and federal law and shall be administratively approved through |
|---|
| 46 | 46 | | 18the issuance of a building permit or similar nondiscretionary permit. |

| 47 | 47 | | 19 (h) The department of energy resources and Massachusetts department of transportation, |
|---|
| 48 | 48 | | 20in consultation with the appropriate and affected parties, by no later than six months following |
|---|
| 49 | 49 | | 21enactment of this legislation, shall develop and publish a model land use ordinance that local |
|---|
| 50 | 50 | | 22governments may elect to adopt. Upon completion, the department of energy resources and |
|---|
| 51 | 51 | | 23Massachusetts department of transportation must post the model ordinance to the department’s |
|---|
| 52 | 52 | | 24internet website and notify local units of government of its availability. |
|---|
| 53 | 53 | | 25 (i) The department of energy resources and Massachusetts department of transportation |
|---|
| 54 | 54 | | 26may periodically publish amendments to the model ordinance to reflect increased electric vehicle |
|---|
| 55 | 55 | | 27adoption and technological advances in the State. Any update shall not require a rulemaking |
|---|
| 56 | 56 | | 28process. Upon completion of any amendment, the department of energy resources and |
|---|
| 57 | 57 | | 29Massachusetts department of transportation must post the updated model ordinance to the |
|---|
| 58 | 58 | | 30department’s internet website and notify local units of government of the amendments. |
