27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |

29 | 29 | | 1 SECTION 1. Section 1 of chapter 164 of the General Laws, as appearing in the 2022 |
---|
30 | 30 | | 2Official Edition, is hereby amended by inserting after the definition of “mitigation” the |
---|
31 | 31 | | 3following:- |
---|
32 | 32 | | 4 “Non-emitting thermal energy,” thermal energy and associated infrastructure that |
---|
33 | 33 | | 5supplies heating, or heating and cooling, from fuel sources whose combustion does not emit |
---|
34 | 34 | | 6greenhouse gases as defined in section 1 of chapter 21N. |
---|
35 | 35 | | 7 SECTION 2. Section 92 of said chapter 164, as so appearing, is hereby amended by |
---|
36 | 36 | | 8adding the following:- |
---|
37 | 37 | | 9 The department may order a gas company to terminate natural gas service to a customer |
---|
38 | 38 | | 10where such proposal ensures that the affected customer retains continuous access to safe, reliable |
---|
39 | 39 | | 11and affordable thermal energy services. A company offering to provide non-emitting thermal |
---|
40 | 40 | | 12energy has satisfied the requirement to supply petitioner. 2 of 2 |

41 | 41 | | 13 SECTION 3: Section 94 of Chapter 143 of the General Laws, as so appearing, is hereby |
---|
42 | 42 | | 14amended by adding the following: |

43 | 43 | | 15 (s): In consultation with the department of energy resources, to develop requirements and |
---|
44 | 44 | | 16promulgate regulations as part of the 2027 update to the state building code, in addition to the |
---|
45 | 45 | | 17requirements of the latest International Energy Conservation Code, requiring all new space |
---|
46 | 46 | | 18cooling technologies installed in new or existing single-, two-, and three- family homes and any |
---|
47 | 47 | | 19other appropriate structure type to be capable of both heating and cooling and integrated with |
---|
48 | 48 | | 20any other heating system into a thermostat-controlled system to operate for heat when cost- |
---|
49 | 49 | | 21effective to do so. |
