26	26	An Act to prevent gas expansion to protect climate, community health and safety..
27	27	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
28	28	of the same, as follows:
29	29	1 SECTION 1: Section 69J of said chapter 164, as so appearing, is hereby further amended
30	30	2by inserting, at the end thereof the following: -
31	31	3 No new gas facility or expansion of an existing gas facility, any part of which falls within
32	32	4a 5 mile radius of an environmental justice neighborhood, shall be approved unless required for
33	33	5the safety of the public.
34	34	6 SECTION 2: Section 69K of said chapter 164, as so appearing, is hereby amended by
35	35	7inserting, at the end thereof the following: -
36	36	8 No new gas facility, or expansion of an existing gas facility, any part of which falls
37	37	9within a 5 mile radius of an environmental justice neighborhood, shall be granted a petition for a
38	38	10certificate unless required for the safety of the public. 2 of 4
39	39	11 SECTION 3. Section 69J ¼ of said chapter 164, as so appearing, is hereby amended by
40	40	12inserting, at the end thereof the following: -
41	41	13 No new gas generating facility or expansion of an existing gas generating facility, any
42	42	14part of which falls within a 5 mile radius of an environmental justice neighborhood, shall be
43	43	15approved.
44	44	16 SECTION 4. Section 69K ½ of said chapter 164, as so appearing, is hereby amended by
45	45	17inserting, at the end thereof the following: -
46	46	18 No new gas generating facility or expansion of an existing gas generating facility, within
47	47	19a 5 mile radius of an environmental justice community, shall be granted a petition for a
48	48	20certificate.

50	50	22 An Act establishing a moratorium on new gas system expansion to prevent gas expansion
51	51	23to protect climate, community health and safety.
52	52	24 Be it enacted by the Senate and House of Representatives in General Court assembled,
53	53	25and by the authority of the same, as follows:
54	54	26 SECTION 1: Section 69J of said chapter 164, as so appearing, is hereby further amended
55	55	27by inserting, at the end thereof the following: -
56	56	28 No new gas facility shall be approved, and nor expansion of an existing gas facility, any
57	57	29part of which falls within a 5 mile radius of an environmental justice neighborhood, shall be
58	58	30approved unless required for the safety of the public. 3 of 4
59	59	31 SECTION 2: Section 69K of said chapter 164, as so appearing, is hereby amended by
60	60	32inserting, at the end thereof the following: -
61	61	33 No new gas facility, or expansion of an existing gas facility, any part of which falls
62	62	34within a 5 mile radius of an environmental justice neighborhood, shall be granted a petition for a
63	63	35certificate, and no expansion of an existing gas facility shall be granted a petition for a certificate
64	64	36unless required for the safety of the public.
65	65	37 SECTION 3. Section 69J ¼ of said chapter 164, as so appearing, is hereby amended by
66	66	38inserting, at the end thereof the following: -
67	67	39 No new gas generating facility or expansion of an existing gas generating facility, any
68	68	40part of which falls within a 5 mile radius of an environmental justice neighborhood, shall be
69	69	41approved.
70	70	42 SECTION 4. Section 69K ½ of said chapter 164, as so appearing, is hereby amended by
71	71	43inserting, at the end thereof the following: -
72	72	44 No new gas generating facility or expansion of an existing gas generating facility, within
73	73	45a 5 mile radius of an environmental justice community, shall be granted a petition for a
74	74	46certificate.
75	75	47 SECTION 3: Section 30 of said chapter 164, as so appearing, is amended by striking out,
76	76	48in line 1 the words “a gas or” and inserting in place thereof the following word: -”an”.
77	77	49 SECTION 4: Said chapter 164, as so appearing, is hereby further amended by inserting
78	78	50after section 86 the following section:- 4 of 4
79	79	51 Section 86A. A town where no gas company exists in active operation, or where no
80	80	52person owns or operates the manufacture and sale of gas, no gas company, nor any other person,
81	81	53shall dig up and open the streets, lanes, and highways of such town in order to construct a gas
82	82	54facility.
