26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 Section 13B of Chapter 90 of the General Laws, as appearing in the most recent edition, |
---|
29 | 29 | | 2is hereby amended by striking subsection (d) and inserting in place thereof the following:- |
---|
30 | 30 | | 3 (d) A violation of this section shall be punishable by a fine of $100 for a first offense, by |
---|
31 | 31 | | 4a fine of $250 for a second offense and by a fine of $500 for a third or subsequent offense. In |
---|
32 | 32 | | 5addition to any fines pursuant to this subsection, an operator who commits an offense under this |
---|
33 | 33 | | 6section shall be required to complete a program selected by the registrar of motor vehicles that |
---|
34 | 34 | | 7encourages a change in driver behavior and attitude about distracted driving. Nothing in this |
---|
35 | 35 | | 8subsection shall authorize the seizure or forfeiture of a hands-free mobile telephone or a mobile |
---|
36 | 36 | | 9electronic device. |
