2525 An Act relative to require enhanced training for distracted driving offenders.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 Section 13B of Chapter 90 of the General Laws, as appearing in the most recent edition,
2929 2is hereby amended by striking subsection (d) and inserting in place thereof the following:-
3030 3 (d) A violation of this section shall be punishable by a fine of $100 for a first offense, by
3131 4a fine of $250 for a second offense and by a fine of $500 for a third or subsequent offense. In
3232 5addition to any fines pursuant to this subsection, an operator who commits an offense under this
3333 6section shall be required to complete a program selected by the registrar of motor vehicles that
3434 7encourages a change in driver behavior and attitude about distracted driving. Nothing in this
3535 8subsection shall authorize the seizure or forfeiture of a hands-free mobile telephone or a mobile
3636 9electronic device.
