2828 An Act relative to Chapter 90B.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1. Chapter 90B, Section 20 of the General Laws is hereby amended by
3232 2inserting at the end of the following section. ''Recreation vehicle'' or ''off-highway vehicle'', any
3333 3motor vehicle designed or modified for use over unimproved terrain for recreation or pleasure
3434 4while not being operated on a public way as defined in chapter 90 including, but not limited to,
3535 5all-terrain vehicles, off-highway motorcycles, dirt bikes, recreation utility vehicles and all
3636 6registered motor vehicles while not being operated on a public way as defined in said chapter 90;
3737 7provided, however, that recreation vehicles and off-highway vehicles operated exclusively for
3838 8agricultural, forestry, lumbering or construction purposes shall not be subject to this chapter and
3939 9it shall be an affirmative defense that such vehicle was being operated for such purposes at the
4040 10time of an alleged violation of this chapter. :- “Any motor vehicle legally registered under 2 of 2
4141 11chapter 90 will not be subject to registration (dual registration) under this chapter but registration
4242 12numbers shall be displayed as required by said chapter 90.
4343 13 SECTION 2. 1st paragraph of Section 22 of chapter 90B of the General Laws is hereby
4444 14amended by striking the words “Provided, however, that the director may exempt a participant of
4545 15a sanctioned race, rally or event who is not a resident of the commonwealth from the
4646 16requirements of this section.”
4747 17 And inserting the following words:- “All participants of a sanctioned race, rally or event
4848 18that is sanctioned by a bonafide state, regional, national or international sanctioning body shall
4949 19be exempt from the requirements of this section.”
5050 20 Chapter 90B, Section 22 of the General Laws is hereby amended by inserting at the end
5151 21of the 1st paragraph:- “Any motor vehicle legally registered under Chapter 90 will not be subject
5252 22to registration under this chapter but registration numbers shall be displayed as required by said
5353 23Chapter 90.”
5454 24 SECTION 3. Section 21 of said chapter 90B, is hereby amended by
5555 25 striking the words “The director may exempt a participant of a sanctioned race, rally or
5656 26event who is not a resident of the Commonwealth from the requirements of this section.”
5757 27 And inserting the following words:- “All participants of a sanctioned race, rally or event
5858 28that is sanctioned by a bonafide state, regional, national or international sanctioning body shall
5959 29be exempt from the requirements of this section
