2525 An Act relative to retrofit headlights in vehicles.
2626 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2727 of the same, as follows:
2828 1 SECTION 1. Section 7 of chapter 90 of the General Laws, as appearing in the 2022
2929 2Official Edition, is hereby amended by inserting, in line 80, after the words “such way.” the
3030 3following sentence:- No motor vehicle so operated shall display a headlamp that: (i) flickers or
3131 4cannot reliably sustain a consistent brightness level; (ii) is improperly installed; (iii) does not
3232 5utilize pulse width modulation, or similar technology to prevent flickering; or (iv) does not meet
3333 6certain other quality standards, as determined by the registrar.
3434 7 SECTION 2. Said chapter 90 is hereby further amended by inserting after section 9D the
3535 8following section:-
3636 9 Section 9E. No person shall manufacture, sell or offer for sale or trade any motor vehicle
3737 10headlamp that: (i) flickers or cannot reliably sustain a consistent brightness level; (ii) does not
3838 11utilize pulse width modulation, or similar technology to prevent flickering; or (iii) does not meet
3939 12certain other quality standards, as determined by the registrar 2 of 2
4040 13 SECTION 3. Not later than 180 days following the passage of this act, the registrar of
4141 14motor vehicles shall, pursuant to chapter 30A, promulgate regulations for the implementation of
4242 15this act, which shall include quality standards for motor vehicle headlamps.
