26 | 26 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
27 | 27 | | of the same, as follows: |
---|
28 | 28 | | 1 SECTION 1. Section 7 of chapter 90 of the General Laws, as appearing in the 2022 |
---|
29 | 29 | | 2Official Edition, is hereby amended by inserting, in line 80, after the words “such way.” the |
---|
30 | 30 | | 3following sentence:- No motor vehicle so operated shall display a headlamp that: (i) flickers or |
---|
31 | 31 | | 4cannot reliably sustain a consistent brightness level; (ii) is improperly installed; (iii) does not |
---|
32 | 32 | | 5utilize pulse width modulation, or similar technology to prevent flickering; or (iv) does not meet |
---|
33 | 33 | | 6certain other quality standards, as determined by the registrar. |
---|
34 | 34 | | 7 SECTION 2. Said chapter 90 is hereby further amended by inserting after section 9D the |
---|
35 | 35 | | 8following section:- |
---|
36 | 36 | | 9 Section 9E. No person shall manufacture, sell or offer for sale or trade any motor vehicle |
---|
37 | 37 | | 10headlamp that: (i) flickers or cannot reliably sustain a consistent brightness level; (ii) does not |
---|
38 | 38 | | 11utilize pulse width modulation, or similar technology to prevent flickering; or (iii) does not meet |
---|
39 | 39 | | 12certain other quality standards, as determined by the registrar 2 of 2 |

40 | 40 | | 13 SECTION 3. Not later than 180 days following the passage of this act, the registrar of |

41 | 41 | | 14motor vehicles shall, pursuant to chapter 30A, promulgate regulations for the implementation of |
---|
42 | 42 | | 15this act, which shall include quality standards for motor vehicle headlamps. |
