2828 An Act to increase safety on public ways.
2929 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3030 of the same, as follows:
3131 1 SECTION 1: General Laws Part I Title XVI Chapter 111E, is amended to include the
3232 2following Section 9B which provides:
3333 3 (a) For the purposes of this section, “incapacitated” shall have the same meaning as
3434 4is defined in Section 9A of Chapter 111E.
3535 5 (b)Where an incapacitated person is found to be the operator of or in possession of a
3636 6motor vehicle on a public way, that motor vehicle shall be towed away and impounded for a
3737 7period of twelve (12) hours.
3838 8 (c)This (12) hour impoundment period shall be calculated from the time the vehicle
3939 9is towed. The costs for the towing, storage and maintenance of the vehicle shall be borne by the 2 of 2
4040 10operator or individual who retrieves the vehicle after the twelve (12) hour hold period is
4141 11complete.
