30 | 30 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
31 | 31 | | of the same, as follows: |
---|
32 | 32 | | 1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the |
---|
33 | 33 | | 2licensing authority of the town of Hudson may grant 1 additional license for the sale of wine and |
---|
34 | 34 | | 3malt beverages not to be drunk on the premises under section 15 of said chapter 138 to Hudson |
---|
35 | 35 | | 4Hives LLC to be operated at the premises located at 45 Main street, Suite 203, in the town of |
---|
36 | 36 | | 5Hudson. The license granted under this section shall be subject to all of said chapter 138, except |
---|
37 | 37 | | 6said section 17. |
---|
38 | 38 | | 7 (b) The licensing authority shall not approve the transfer of the license granted pursuant |
---|
39 | 39 | | 8to this act to any other location, but it may grant the license to a new applicant at the same |
---|
40 | 40 | | 9location if the applicant files with the licensing authority a letter from the department of revenue |
---|
41 | 41 | | 10and a letter from the department of unemployment assistance indicating the license is in good 2 of 2 |
---|
42 | 42 | | 11standing with those departments and that all applicable taxes, fees and contributions have been |
---|
43 | 43 | | 12paid. |
---|
44 | 44 | | 13 (c) If a licensee terminates or fails to renew a license granted under this act or any such |
---|
45 | 45 | | 14license is cancelled, revoked or no longer in use, it shall be returned physically, with all of the |
---|
46 | 46 | | 15legal rights, privileges and restrictions pertaining thereto to the licensing authority which may, |
---|
47 | 47 | | 16within 3 years after such return, then grant the license to a new applicant at the same location and |
---|
48 | 48 | | 17under the same conditions as specified in this section, otherwise such license shall dissolve. |
---|
49 | 49 | | 18 (d) The license authorized to be granted under this act shall be issued within 3 years after |
---|
50 | 50 | | 19the effective date of this act; provided, however, that if the license is originally granted within |
---|
51 | 51 | | 20that time period it may be granted to a new applicant under subsection (b) or (c) thereafter. |
---|
52 | 52 | | 21 SECTION 2. This act shall take effect upon its passage. |
