2626 An Act relative to recycling cannabis infused beverages.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Section 321 of chapter 94 of the General Laws, as appearing in the 2022
3030 2Official Edition, is hereby amended by inserting after the word “water”, in line 6, the following
3131 3words:- , cannabis-infused beverages.
3232 4 SECTION 2. Said section 321 of said chapter 94, as so appearing, is hereby further
3333 5amended by inserting after the definition of “Bottler” the following definition:-
3434 6 “Cannabis-infused beverage”, a legally distributable beverage containing cannabinoid or
3535 7hemp or which has a cannabinoid profile, as those terms are defined in section 1 of chapter 94G.
3636 8 SECTION 3. Section 323 of said chapter 94, as so appearing, is hereby amended by
3737 9inserting after the word “distributor”, in line 15, the words:- ; provided, that a distributor shall
3838 10not be required to pay any such handling fee for any cannabis-infused beverage container. 2 of 2
3939 11 SECTION 4. Said section 323 of said chapter 94, as so appearing, is hereby further
4040 12amended by inserting after the word “accepted”, in line 33, the following words:- ; provided, that
4141 13a redemption center shall accept a cannabis-infused beverage container if it meets all of the
4242 14requirements for a redeemable beverage container.
4343 15 SECTION 5. Said section 323 of said chapter 94, as so appearing, is hereby further
4444 16amended by inserting after the word “container”, in line 38, the words:- ; provided, that a
4545 17distributor shall not be required to pay any such handling fee for any cannabis-infused beverage
4646 18container.
